2001-163 RESOLUTION NO. 2001-163 RESOLUTION GRANTING AN UTILITY EASEMENT WITHIN A PUBLIC PARK NORTH OF WOODCREST DRIVE WHEREAS, Ameritech, Rock County Rural Electric and Charter Communications have inadvertently placed utility lines in an unnamed park adjoining Woodcrest Drive on the City's northeast side and have requested that the city grant them an easement to accommodate their utility lines, and WHEREAS, the ut'tlities companies have agreed to bury their lines deeper and pay for the cost of lowering the grades in a portion of this planned park area; and WHEREAS, grading and seeding of this unimproved park will benefit the City and area residents; and WHEREAS, the City Planning, Engineering and Parks Departments have determined that the location of the proposed easement will not cordlict with future use or improvements in the park; and WHEREAS, on 4 June 2001 the Plan Commission reviewed the request and found that granting the easement to be consistent with City plans; and WHEREAS, the Janesville City Council finds that granting the easement in the desired location is consistent with the public interest; NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Janesville that the City of Janesville hereby grants the following described easement for the installation of underground utilities: Part of the NW 1/4 of the SE 1/4 of Section 8. T3N, R13E of the 4th P.M., City of Janesville, Rock County, Wisconsin. Described as follows: Commencing at the southwast comer of Lot 80 in the Fifth Addition to Fox Hills Estates, a recorded subdivision in the City of Janesville, (which is also the Point of Beginning): thence N 53 degrees 08'23" E a distance of 400.00 feet to an iron pin; thence S 36 degrees 52' 14"E a distance of 20.00 feet; thence S 53 degrees 08'23" W a distance of 400.00 feet to the east right-of-way line of Woodcrest Drive; thence N 36 degrees 52'14" W a distance of 20.00 feet along said right-of-way line to the Point of Begiuning. Said parcel is located along the northwest property line of dedicated parkland in the Fourth Addition to Fox Hills Estates, a recorded subdivision in the City of Janesville. BE IT FURTHER RESOLVED, that the granting of this easement is subject to the utility companies agreeing to pay for the grading and seeding of a portion of the park area as approved by the City Engineering and Parks Departments. BE IT FURTHER RESOLVED, that upon adoption of this resolution, the City Clerk is directed to record a certified copy of this resolution with the Register of Deeds of Rock County, Wisconsin and the City Administration is authorized to execute the appropriate documents conveying such easement to said utility companies.
