A resolution vacating a public alley located between the 200 blocks of North Chathara and
North Palm Streets.
WHEREAS, a public alley located between the 200 blocks of North Chatham and North Palm
Streets so designated and previously dedicated for right-of-way purposes is hereby determined to
be no longer needed for public use, and therefore, the public interest requires the vacation of such
street portion; and
WHEREAS, said alley is not essential for public use and the applicant's, who collectively own
the adjoining properties to the north and south, desire to terminate the public use of said alley and
thereafter utilize said lands for private access to their respective properties; and
WHEREAS, the proposed alley vacation has been referred to the Plan Commission for its
consideration and report as required by 62.23(5), Wisconsin Statutes; and
WHEREAS, a public hearing was held on the vacation of such alley portion and notice served as
required by 66.296, Wisconsin Statutes;
NOW THEREFORE LET IT BE RESOLVED BY THE COMMON COUNCIL OF THE
CITY OF JANESVILLE that the following described alley is hereby vacated and discontinued
pursuant to 66.296 and 66.22(1m), Wisconsin Statutes:
Part of Mitchell's 3ra Addition to the City of Janesville, Located in the SW 1/4 of the NE 1/4 of
Section 35, T.3N., R. 12E, City of Janesville, Janesville Township, Rock County Wisconsin,
described as follows:
The platted 18.48' (recorded as .25 chains) alley, located between N. Palm Street (recorded as
Palm St.) and N. Chatham Street (recorded as Chatham St), and also between Ravine Street and
Laurel Ave. (recorded as Bluff St.) Said alley situated south of Lots 171 and 130 and North of
Lots 172 and 129 of Mitchell's 3~a Addition to the City of Janesville.
BE IT FURTHER RESOLVED that vacation of said alley by the City of Janesville does not
relinquish the rights of private public utilities to use the former right-of-way for utility purposes
that may already conducted therein.
