A Resolution authorizing the sale of a portion of land to the Wisconsin Department of
Transportation on the southernmost side of the City to accommodate the construction of the
Highway 11 Bypass.
WHEREAS, the City of Janesville, Rock County, Wisconsin, is the owner of a certain piece
of real property located in the southwest part of the City within the Rock River Parkway,
legally described as follows:
Part of the NE¼ of the NW¼ of Section 15 T.2N., R. 12E. of the 4th P.M., City of Janesville,
Rock County, Wisconsin.
DESCRIBED AS FOLLOWS: Commencing at the northwest comer of said Section 14; thence
S. 1 °09'43"E. 628.22 feet; thence S.88°11 '5 I"E. 173.58 feet; thence S.66°22'44"E. 329.36 feet;
thence S.23°23'53"W. 314.96 feet; thence N.70°59'25"W. 402.75 feet; thence N.85°08'56"W.
390.90 feet; thence S.88°45'48"W. 2462.16 feet to the existing east right-of-way line of South
River Road; thence continuing S.88°45'48"W. 50.00 feet to the existing west right-of-way line
of South River Road; thence S.88°47'58"W. 342 feet more or less to a point along the west bank
of the Rock River, also being the point of beginning; thence continuing S.88°47'58"W. 675 feet
more or less to the east right-of-way line of the Wisconsin and Southem Railroad; thence
N.8°57'01"E. along said right-of-way line 285 feet; thence N.88°49'3 I"E. 674 feet more or less
to a point along the west bank of the Rock River; thence southerly along the west bank of the
Rock River to the point of begiuning.
WHEREAS, the Wisconsin Department of Transportation finds, in order to accommodate the
construction of the Highway 1 ! Bypass, that a portion of land owned by the City is needed for
road purposes; and
WHEREAS, on August 7, 2000, the Janesville Plan Commission reviewed the sale of land to
the Wisconsin Department of Transportation and found it to be consistent with City plans, but
did not review the fmancial aspects of this transaction; and
WHEREAS, the Wisconsin Department of Transportation has offered to purchase this parcel
of land for the sum of Ten Thousand Six Hundred and 00/100 ($10,600.00) Dollars.
NOW, THEREFORE, BE IT RESOLVED that the City Manager and his designee(s) may,
from time to time, negotiate, draft, amend, execute and enter into such contracts, documents,
and agreements and take such other actions as the City Manager and/or his designees may
deem necessary or desireable to effectuate the intent of this resolution; and
BE IT FURTHER RESOLVED that the City retain a utility easement and a bike/pedestrian
trail easement along the eastern portion of this property, as defined by the Engineering
Department.
