A resolution authorizing the acceptance by the City of a conveyance of real property located west of
Afton Road and south of the proposed Highway 11 By-pass from the Wisconsin Department of
Transportation.
WHEREAS, the Wisconsin Department of Transportation, in the acquisition of properties for the State
Highway 11 Bypass identified a property owned by the City of Janesville necessary for the road project;
and
WHEREAS, a portion of the land proposed for purchase was purchased with State Lawcon funds whose
rules require that in order for the City to sell this land, replacement lands of equal or greater value must be
obtained; and
WHEREAS, the Wisconsin Department of Transportation in their purchase of lands for the State Highway
11 Bypass acquired a 7.8 acres of surplus property which is not needed for the road project and propose to
convey this property to the City to be used as replacement lands; and
WHEREAS, the Wisconsin Department of Natural Resources has concluded that the 7.8 acres which the
Wisconsin Department of Transportation is proposing to convey to the City will be acceptable replacement
lands; and
WHEREAS, on December 18, 2000 the City of Janesville Plan Commission has reviewed this conveyance
of land to the City and found it to be a future greenbelt and its dedication to be in accordance with the
City's long range plan, but did not review or comment upon the financial aspects of this proposed
transaction; and
WHEREAS, in order to facilitate the State Highway 11 Bypass, the Common Council of the City of
Janesville hereby finds and determines that the conveyance of this land to the City is beneficial to the City,
community and its citizens.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Janesville that it
hereby approves and authorizes the City of Janesville's acceptance of the conveyance from the Wisconsin
Department of Transportation; and
BE IT FUR~I'H ER RESOLVED, that the City Manager and his designee(s), on behalf of the City of
Janesville, is/are hereby authorized and empowered to negotiate, drain, modify, review, execute, enter into
additional agreements, record, file and/or to make minor modifications and/or amendments to any and all
documents and agreements and to take whatever actions as the City Manager may determine from time to
time necessary and/or desirable to effectuate the intent of this resolution, transaction(s), and/or project.
