A Resolution authorizing the renewal and extension of the current Golf Courses Lease
Agreement with Crown Golf Properties, L.P.
Whereas, the City of Janesville, a Wisconsin municipal corporation, located in Rock
County, owns two (2) municipal public golf courses known as Riverside Golf Course and
Blackhawk Golf Course in the City; and
Whereas, the City currently leased the operation and management of each of these two
golf courses to Crown Golf Properties, L.P., an Illinois corporation which has now
converted its operations, ownership and management to an Illinois limited liability
partnership; and
Whereas, the current lease terminated on December 31, 2001.
Whereas, the City and Crown Golf executed a lease extension agreement for the period
of January 1, 2001 to March 1, 2001 to accommodate ongoing lease negotiations; and
Whereas, the City and Crown Golf have negotiated the substantive and detailed terms,
conditions and provisions of a new, renewed golf course lease/management agreement
for Crown Golffs operation and management of Janesville's two public municipal golf
courses, the terms of which are set forth in a new Golf Course Lease Agreement that will
commence on the lStof March, 2001 for a term of approximately 10 years, ending on the
31st day of December, 2010; and
Whereas, the Janesville Plan Commission has previously reviewed the public use and
private use considerations for leasing the municipal golf courses under such a
lease/management arrangement on the 15th day of February, 1982, finding the same
consistent with City ordinances, policies and for the benefit of the community; and
Whereas, this lease is found to be in the best interest of and benefit to the City,
community, its residents, citizens and facility users;
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of The City of
Janesville that it hereby authorizes and approves the City of Janesville's entry into the
proposed renewed and newly negotiated Golf Course Lease Agreement with Crown Golf
upon the terms and conditions set forth in said agreement; and
BE IT FURTHER RESOLVED, that the City Manager and his designee(s), on behalf
of the City of Janesville, is/are hereby authorized and empowered to negotiate, draft,
modify, review, execute, and enter into additional agreements, record, file and/or make
minor modifications and/or amendments to any and all documents, papers, forms and
agreements, and to take whatever other actions as the City Manager may determine, from
time to time and at any time, necessary and/or desirable to effectuate the intent of this
Resolution and/or project.
