2001-114REVISED RESOLUTION NO. 2001-114 A Resolution Vacating Devon Drive. WHEREAS, Devon Drive designated and previously dedicated for right-of-way purposes is hereby determined to be no longer needed for public use, and therefore, the public interest requires the vacation of such street portion; and WHEREAS, said street portion is not essential for use and the owners of the adjoining properties, desire to utilize said lands for the expansion of the existing uses on those sites; and WHEREAS, the proposed street vacation has been referred to the Plan Commission for its consideration and report as required by 62.23(5), Wisconsin Statutes; and WHEREAS, a public hearing was held before this governing body on the vacation of such street portion and notice served as required by 66.296, Wisconsin Statutes; NOW THEREFORE LET IT BE RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the following described portion of Devon Drive be and is hereby vacated and discontinued pursuant to Sections 66.296 and 66.22(lm), Wisconsin Statutes: Located in the NW ¼ of the NE ¼ of Section 17, Town 3 North, Range 13 East, City of Janesville, Rock County, Wisconsin, described as follows. All of Devon Drive, West of Danbury Drive as platted in Briar Crest Estates. Recorded as Document #665478 on October 8, 1963 at 1:10 p.m. in Volume 22, Pages 8 and 9 of Plats, at the Rock County Register of Deeds. NOW THEREFORE BE IT FURTHER RESOLVED that the City of Janesville hereby retains a blanket easemem for utility purposes over the emire land area herein described; and BE IT FURTHER RESOLVED that the City also retains a 30-foot wide bike trail/pedestrian walkway easement centered on the right-of-way area herein described; and BE IT FURTHER RESOLVED that the adjoining residential properties north and south of the proposed street vacation should be aware that in the future the city may construct a bikeway/pedestrian walkway connection from Danbury Drive to the west within the bike trail/pedestrian walkway easement area.
