98-1199ORDINANCE NO. 98-1199 An ordinance annexing territory in Section 3, T.2N., R.12E. of the 4th P.M., Town of Rock, Rock County, Wisconsin. WHEREAS, a petition signed by all the owners of all the land within such territory proposed to be annexed has been filed with the City Clerk; and WHEREAS, there are no electors residing in the territory; and WHEREAS, the necessary notices have been duly prepared, provided and served as required by law to all persons affected; and WHEREAS, this ordinance does not contain temporary zoning; and WHEREAS, the Department of Administration has not found the proposed annexation to be against the public interest; and WHEREAS, the Common Council has determined that this annexation is in the public interest. NOW THEREFORE THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. The territory described as follows is hereby annexed to the City of Janesville. PART OF THE N.E. 1/4 OF THE S.W. 1/4 AND PART OF GOVERNMENT LOT 2, BEING ALL A PART OF SECTION 3, T.2N., R. 12E. OF THE 4TH P.M., ROCK TOWNSHIP, ROCK COUNTY, WISCONSIN, DESCRIBED AS FOLLOWS: Beginning at the intersection of the Southwesterly right-of-way line of Rockport Park Drive and the East-West centerline of Section 3, aforesaid, said point being 1701 feet more or less North 90 degrees 00'' East of the West 1/4 corner of said Section 3; thence continuing North 90 degrees 00" East along said East-West centerline, being also the North line of Lot 1 of Certified Survey Map Document No. 990738 as recorded in Volume 11 on Pages 524 and 525 a distance of 908 feet more or less to the Northeast corner of said Lot 1; thence South 4 degrees 00' East along the Northeasterly line of said Lot 1 a distance of 280 feet; thence South 60°23'50" East 213.44 feet; thence South 74 degrees 10' East 739.93 feet to the Northwesterly right-of-way line of Afton Road; thence Southwesterly along a curve convexed Northwesterly 391.85 feet, having a radius of 4633.66 feet, the chord being South 38°59'41" West 391.73 feet; thence South 35 degrees 34'40.' West 320.1 feet to the Southwesterly right- of-way line of said Rockport Park Drive; thence North 58 degrees 22' West 505.6 feet; thence North 47 dgrees 17'50 West 1308.1 feet to the place of beginning. Containing 18.95 acres. SECTION II. After this annexation becomes effective, the above described property shall be exempt from and not subject to further taxation and assessments in the Town of Rock and thence forth shall be subject to taxation and assessment as part of the City of Janesville for any and all purpose provided by law. SECTION III. All the territory annexed by this ordinance is hereby made part of Ward 36 of the City of Janesville. SECTION IV. There are no residents in the area proposed for annexation. SECTION V.
