98-1169 ORDINANCE NO. 98-1169 An ordinance amending the City's Subdivision Regulations to allow narrower street right- of-way and street widths on certain streets with penalties as set forth in the Janesville General Ordinance Chapter 17.56. TIiE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. Section 17.04.030 B.3 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: 17.04.030 B.3. The official map of the city, and the adopted Janesville Area Long Range Transportation Plan as amended from time to time; SECTION II. Section 17.04.030 B.6. of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: 17.040.030 B.6. Whenever a parcel to be platted or divided by certified survey embraces any part of a street, highway or greenbelt designated in the master plan or official map, such part of such proposed public way shall be dedicated by the subdivider in the location, and at a width indicated in the approved Janesville Area Long Range Transportation Plan, or the master neighborhood plan. SECTION III. Section 17.08.130 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: 17.08.130 Janesville Area Long Range Transportation Plan. "Janesville Area Long Range Transportation Plan" means the long range transportation plan which encompasses the city and the towns of Janesville, Harmony, LaPrairie and Rock. SECTION IV. Section 17 of the Code of General Ordinances of the City of Janesville is hereby amended to change references to the "JATS Plan" in the Sections 17.08.210 A, 17.08.210 C. and 17.40.020 to the "Janesville Area Long Range Transportation Plan": SECTION V. Section 17.40.030 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: 17.40.030 Janesville Area Long Range Transportation Plan. The right-of-way width of all proposed streets shall conform to the adopted Janesville Area Long Range Transportation Plan. SECTION VI. Section 17.40.060 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: 17.40.060 Width Requirements. The right-of-way and road way of all streets shall be of the width specified in the Janesville Area Long Range Transportation Plan, on the official map or master plan, or if no width is specified in the Janesville Area Long Range Transportation Plan, on the official map or master plan, they shall be not less than the width specified below: A. Primary and standard arterials, one hundred feet; B. Collector streets, eighty feet; C. Minor and local streets, seventy feet; D. Alleys, thirty feet; E. Frontage roads, thirty feet. SECTION VII. Section 17.40.065 of the Code of General Ordinances of the City of Janesville is hereby created to read as follows: 17.40.065 Narrow Street Width and Right-of-way Applications. Narrow street and right-of-way widths may be considered for cul-de-sac streets, loop streets and streets of limited total length where the street is not planned to be extended. The Plan Commission may consider the application of a reduced right-of-way width to 60 feet and a street width of 28 feet from face of curb to face of curb based on the following criteria: A.The maximum total length of a narrow street shall not exceed 1500 feet measured from T-intersection to T-intersection. In the case of a cul-de-sac street, the length shall be measured from T-intersection to center of the cul-de-sac area. B. The permitted land use along the narrow street shall be restricted to single-family residences. Two-family residences may be located at corner lot locations provided each dwelling unit shall have an exclosed two-car garage with only one driveway, up to a maximum of 24 feet in width located on the narrow street. An additional driveway may be located on the standard width street adjoining the corner lot, or if no driveway is located on the narrow street, two driveways may be located on the standard width street. Two-family residences shall not be alloed at the corner lot location of two intersection norrow streets. C. Parking may be restricted on one side. ADOPTED: March 9, 1998 APPROVED: Steven E.
