99-1268AREVISED ORDINANCE NO. 99-1268A An ordinance changing and establishing the zoning classifications of land located in the southeast section of the City in the vicinity of Beloit Avenue and Avalon Road south of Burbank Avenue. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. The zoning classification of the following described property is hereby changed from R3, General Residence District, to R1, Single and Two-Family Residence District: The east 1,035 feet of the north 50 acres of the south 1/2 of the southeast lA of Section 12, Town 2N, Range 12 East, 4z P.M., City of Janesville, Rock County, Wisconsin, excepting therefrom that portion lying north and northwest of the following described line: beginning on the east line of said section at a point 435 feet south of the centerline of Burbank Avenue, thence North 88032' west parallel with Burbank Avenue 377.03 feet to the southerly extension of the centerline of Pierce Street; thence in a direct line to a point on the southerly extension of the east line of Polk Street, which point is 680 feet south of the south line of Burbank Avenue as measured along the east line of Polk Street on its southerly extension. SECTION H. The zoning classification of the following described property is hereby changed from B2, Community Shopping District, to RI, Single and Two-Family Residence District: That part of the southeast ~A of the southeast lA of Section 12, Town 2 North, Range 12 East, 4~ P.M., City of Janesville, Rock County, Wisconsin, bounded as follows: on the north by Block 11 in Second Sundown Acres Subdivision, a subdivision plat recorded on July 13, 1965 in Volume 22 of Plats, Page 34; on the east by the centerline of Beloit Avenue; on the south by a line parallel with and 435 feet south of the centerline of Burbank Avenue as measured along the centerline of Beloit Avenue; and on the west by the centerline of Pierce Street and such line extended south. SECTION IlL The zoning classification of the following described property is hereby established as RI (Single and Two Family Residence) District: Commencing at the SE comer of Section 12, T.2N., R. 12E. of the 4th P.M., Rock County, Wisconsin; thence South 00026'42'' East, a distance of 70.00 feet; thence North 88o50'07'' West, a distance of 2565.06 feet to the centerline of said Section 12; thence North 00ol 7'47" West along said centerline a distance of 564.97 feet; thence South 88050'07'' East, a distance of 2563.59 feet to a point along the east line of said Section 12; thence South 00026'42'' East along said east line, a distance of 495.01 feet to the Point of Begiuning. Containing 33.25 acres, more or less. SECTION IV. The zoning classification of the following described property is hereby established as M 1 (Light Industrial) District: Parcel A: The South ~/~ of the SE lA of Section 12, T.2N., R.12E. of the 4~ P.M., Rock Township, Rock County, Wisconsin, excepting the northerly 50 acres therefrom, also excepting the east 40.0 feet therefrom. Parcel B: Part of the NE ~A of Section 13, T.2N., R. 12E., Rock Township (including Lot One, Certified Survey Map recorded in Volume 11, Pages 121 and 122) and Part of the NW lA of Section 18, T.2N., R. 13E., LaPrairie Township, both'being of the 4~h P.M., Rock County, Wisconsin. Excepting therefrom the property legally described in Section Iii of this ordinance. SECTION V. The following conditions will apply to the property described in Section IV of this ordinance: The City shall require a berm along the north boundary of the land proposed for industrial uses. This berm will be a minimum of 4 to 6 feet in height and be landscaped. The City shall place in the deed restrictions for the industrial area a prohibition on noise producing uses on industrial lots, which directly adjoin the park/open space area, and further that no unscreened outside storage of materials shall occur on these lots. Uses including metal stamping, motor freight terminals, metal grinding, vehicle repair and other industrial activities that produce significant noise are prohibited. All industrial uses located on the lots that directly adjoin the park/open space area shall be reviewed as conditional uses requiring Plan Commission review and approval of site plans. All of the buffer area on the north boundary of the industrial park shall be identified as parks and open space use. The area shown as future residential on the TIF map should be changed to parks and open space use. In addition, an ordinance to zone the entire park/open space area to Conservancy will be introduced and support by the Administration which would restrict its use to parks and open space uses. The Administration will introduce and support the vacation of South Jackson Street currently existing south of Muir Street. This will prevent the future southward extension of that street. The Plan Commission shall prepare a neighborhood plan for the vacant residential area west of Jackson Elementary School. Burbank Avenue, in the neighborhood plan, shall not be connected as a through street from Center Avenue to Beloit Avenue. It will instead be disconnected in order to discourage through traffic. None of the proposed streets within the proposed industrial park shall be connected to the residential area to the north. The City will install a fence along the southern boundary of Jackson School, if the School District so requests~ ADOPTED: September 27, 1999 APPROVED: en E.
