99-1251ORDINANCE NO. 99-1251 An ordinance changing the zoning classification of portions of the Janesville Sand & Gravel property located south of the intersection of USH 14 and Kennedy Road from Mining to M1, with a penalty and injunctive relief for a violation thereof as set forth in Section 18.28.010 of the Code of General Ordinances of the City of Janesville. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. The zoning classification of the following described property is hereby changed from Mining District to M1, Light Industrial District: Part of the NE.l/4 of the NE.l/4 of Section 13, T.3N., R.12E. of the 4~ P.M., City of Janesville, Rock County, Wisconsin described as follows: Commencing at a cut stone monument at the East lA comer of said Section; thence N.88°12'15"W. along the East-West centerline of said Section, 110.68 feet to the West line of the Union Pacific Railroad property, also being at the place of beginning for the land to be herein described; thence S.24°40'25"W. along said West line, 562.17 feet; thence Northwesterly along a curve to the left, 589.93 feet, having a radius of 463.34 feet and a chord bearing N.33°36'45"W. 550.89 feet to a point of tangency; thence N.70°05'15"W. 20.0 feet to a point of curve; thence Northwesterly along a curve to the left, 64.05 feet having a radius of 641.01 feet and a chord bearing N.72°57'W. 64.02 feet to a point of tangency; thence N.75°48'45"W. 153.11 feet to a point of curve; thence Westerly along a curve to the left, 120.83 feet having a radius of 558.69 feet and a chord bearing, N.82°00'30"W. 120.60 feet to a point of tangency on said East-West centerline; thence S.88°12'15"E. along said East-West centerline, 887.95 feet to the place of beginning. Containing 2.89 acres. SECTION II. Section V. A. 7. of the 30 October 1997 Management and Reclamation Plan for Lands Located East of USH 51 and North of Black Bridge Road Including Lands Zoned Mining by Ordinances 91-731, 91-732 and 97-1148 is hereby amended as follows: Boundary Management. All perimeters will have a minimum planting area ranging in width from 20 to 50 ~'~^~ .... ~"~"~ ...... ...... o ___ ~_!~ng t~em feet as shown on the Conceptual End Use Landscaping Plan labeled Exhibit F amended 28 June 1999 except those areas to be bermed as outlined in the end use topography plan. ~27_ p Planting areas that are 30feet or greater in width shall be planted with a minimum of three offset continuous rows of coniferous trees. Planting areas that are less than 30feet in width shall be planted with two offset rows of coniferous trees. Rows shall be a minimum of 8 feet on center. Conifers within the rows shall be 8-10 feet on center. Planting may be altered to accommodate existing plant materials (~%e ................. ~v~ ~. ~, ~,~ ...... ,x Permanently bermed areas shall be stabilized with erosion controlling plant'mgs. In addition, berms shall be graded to support the planting of coniferous trees and wildlife shrubs on a concave surface or side slopes. (Maximum side slope of 2:l.) Such plantings shall comply with the end use landscaping plan. ORDINANCE NO. 99-1251 PAGE 2 Temporary berms may be located to the interior of the required 59 feet planting areas. Temporary berms are intended to be used for storage of topsoil, clay and other soil types to be used in the future for landfill cover, slope stabilization, root zone or topsoil. Such berms will be stabilized with acceptable vegetation if they will remain in place for more than one year. All boundaries shall be bermed and/or planted in accord with Exhibit F and within the dates specified on that plan except in those areas where existing overburden stockpiles must be significantly removed.
