99-1237REVISED ORDINANCE NO. 99-1237 An ordinance changing the zoning classification of a portion of property located at 1405 Milton Avenue from R2, Limited General Residence District with Parking Overlay to B3, General Commercial District. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. The zoning classification of the following described property is hereby changed form R2 (Limited General Residence District) with Parking overlay to B3 (General Commercial District): Part of the SW ¼ of Section 19, T. 3 N., R. 13 E., of the 4th P.M., City of Janesville, Rock County, Wisconsin, described as follows: Commencing at the northeast comer of Lot 4, Block 9, Boies Addition to the City of Janesville and the point of beginning for the land heroin described; thence northwest along the north line of said Lot 4 130 feet to the centerline of Woodman Road; thence southwest along said centerline 105 feet; thence east 33 feet more or less the to the southwest comer of Outlot C, Block 9, of said Boies Addition to the City of Janesville; thence east 109.1 feet to the east line of said Lot 4 of Boies Addition; thence northeast along the east line of said Lot 4 50 feet more or less to the northeast comer of said lot and the point of beginning. SECTION II. The rezoning of the above-described property is conditioned upon compliance with the terms ora Restrictive Covenant as recorded with the Rock County Register of Deeds on 18 March 1980 as Document Number 921375 on Card 41, Image 156. Said Restrictive Covenant prohibits ingress and egress from said property to Woodman Road. The recording of the Restrictive Covenant was a condition ora rezoning of the above described property in 1980 from RI to R1 with Parking Overlay and it is hereby continued to apply to this rezoning. SECTION III. The rezoning of the above-described property to B3 is subject to the following special condition and/or requirement: Installation of a five (5)-foot wide landscape strip along the west line of the subject property and extending south to the existing curb opening along Woodman Road.
