99-1235ORDINANCE NO. 99-1235 An ordinance increasing the current $2,250 per acre storm sewer assessment rate to $3,050 per acre and an additional $200 each subsequent 1 January in 2000 and 2001, with a penalty for violations thereof not less than $25 nor more than $200 with incarceration upon non- payment of the forfeiture. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. Section 17.44.010 B. of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: B. At the time any plat, certified survey or other subdivision is presented for approval, the subdivider shall deposit with the City Clerk a sum of money to be used to pay for storm sewers. No such money shall be spent for any purpose except to pay for storm sewers. The City shall charge Three Thousand Fifty Dollars ($3,050.00) per acre for storm sewer construction. Commencing 1 January 2000, the City shall annually charge an additional Two Hundred Dollars ($200.00) per acre for storm sewer construction effective each subsequent January 1 in 2000 and 2001. The total cost shall be computed by multiplying the cost per acre by the total number of acres included in the plat, certified survey or other subdivision. Beginning in 2001, the assessment rate will be evaluated annually and a new rate established January 1 of each year to assure recovery of not less than 75% of the cost of storm sewer construction. The City Council shall be advised of the new rate by January 1 of each year. SECTION II.
