2007-412 Resolution No. 2007-412 A Resolution Authorizing the City to Enter Into a Lease with Penny Reynolds for the Property Located at 654 South Franklin Street, Janesville, Wisconsin. WHEREAS, the City of Janesville owns a vacant residential lot located at 654 South Franklin Street, Janesville, Wisconsin; and WHEREAS, the property at 654 South Franklin Street was purchased in 1995 for future City of Janesville uses and right of way purposes; and WHEREAS, the City currently maintains the vacant residential lot by snow removal and lawn care: and WHEREAS, the City desires to maintain ownership of the property; and WHEREAS, a resident requested a lease agreement with the City so she may enjoy and maintain the property; and WHEREAS, the specific terms, payments and conditions thereto have been negotiated by and between the City Administration and Ms. Penny Reynolds and set into a written document called the Lease, a true and correct photocopy of which is attached hereto and incorporated herein as if fully set forth verbatim; and WHEREAS, such Lease terms and conditions therein are permitted by law and the Common Council is empowered to enter into such Lease, pursuant to sections 62.11 (5), 62.22,62.23 and other pertinent provisions of the Wisconsin Statutes and law; and WHEREAS, entering into said Lease is in the best interest of the City of Janesville and of benefit to the community and its residents, businesses, and taxpayers. NOW, THEREFORE, BE IT RESOLVED, BY THE Common Council of the City of Janesville that they hereby approve and authorize the City Manager to execute and enter into, on behalf of the City of Janesville, the attached Lease with Ms. Penny Reynolds; and BE IT FURTHER RESOLVED, that the City Manager is hereby authorized to negotiate and execute such documents, papers, agreements, amendments and forms, to take whatever other actions and to make whatever other changes to the Lease and such other documents, papers, agreements, amendments and forms as the City Manager may, from time to time, find necessary, desirable and/or beneficial to effectuate the Lease and/or the intent of this Resolution on the City's behalf.
