2007-373 RESOLUTION NO. 2007- 373 A resolution authorizing the City Manager to proceed with the sale of surplus property located at 2010 Beloit Avenue. WHEREAS, the City of Janesville owns the following described parcel: Part of the NE%oftheSE%ofSection 12T.2N., R.12E. of the 4th P.M., City of Janesville, Rock County, Wisconsin. DESCRIBED AS FOLLOWS: Commencing at the east % corner of said Section 12; thence S.76°06'08"W. 165.65 feet to the place of beginning; thence S.88°56'59"E. 96.13 feet; thence S.39°38'39"E. 15.85 feet; thence S.0027'01 "E. 167.85 feet; thence N.89°00'04"W. 110.84 feet; thence N.1 °02'43"E. 179.91 feet to the place of beginning. WHEREAS, the property consists of approximately 0.45 acres of land located at 2010 Beloit Avenue and was purchased to facilitate the Beloit Avenue road widening project; WHEREAS, the City will retain the necessary right-of-way along Beloit Avenue for the road widening project, however, the remaining parcel which is developed with a commercial building and is zoned B3, General Commercial, is not necessary for City purposes and has been determined to be surplus property appropriate for sale; and WHEREAS, the Plan Commission has reviewed this at its meeting held on 5 February 2007 and found the sale consistent with city plans and recommended that the City Council proceed with the sale of this property, but further noted that the Plan Commission has not reviewed the financial aspects of this transaction; and WHEREAS, the Common Council of the City of Janesville does hereby find that this property is surplus and is no longer needed for City purposes and that the proposed transaction is to the benefit and the best interest of the citizens and the City of Janesville. NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL of the City of Janesville that it hereby authorizes and directs the City Manager and the City Clerk to negotiate, enter into and execute, on behalf of the City of Janesville, the sale of such property; and to negotiate and execute such documents, papers and forms as may from time to time be necessary and/or desirable to effectuate such transactiÓn and the intent of this resolution as the City Manager may decide; and RESOLUTION NO. 2007-373 PAGE 2 BE IT FURTHER RESOLVED that the City Manager is hereby authorized to take whatever other actions or to make whatever other minor changes that may be necessary to effectuate this land transaction.
