Minutes 01-08-2007.doc PROCEEDINGS OF THE CITY COUNCIL CITY OF JANESVILLE, WISCONSIN REGULAR MEETING January 8, 2007 Approved: January 22, 2007 VOL. 57 NO. 23 Regular meeting of the City Council of the City of Janesville held in the Municipal Building on January 8,2007. The meeting was called to order by Council President Tim Wellnitz at 7:00 p.m. Council President Tim Wellnitz led the Council in the Pledge of Allegiance. Present: Council President Tim Wellnitz, Councilmembers Brien, Tom Wellnitz, Williams, Brunner, DeGarmo, and Addie. CONSENT AGENDA Minutes of the regular meeting of December 26, 2006. Minutes of the closed session of December 11, 2006. Licenses; and Recommendations of the Alcohol License Advisory Committee. Authorization for the Administration to deny a liability claim for Linda S. Brenden in the amount of $8,200. Authorization for the Administration to deny a liability claim for Margaret Pearson in the amount of $50,000. Council President Tim Wellnitz stated that the Consent Agenda would be approved if there were no objections. There were no objections. Special recognition: A proposed resolution in commendation of Patricia Hoff's twenty-seven years of service to the City of Janesville. Councilmember Brunner moved to adopt said resolution, seconded by Councilmember Tom Brien and passed unanimously. (File Res. No. 2007-367) OLD BUSINESS 1. Requests and comments from the public regarding items on the Agenda not requiring a public hearing. AI Lembrich, 541 Miller Avenue, expressed his concerns about the costs associated with the Municipal Building's remodeled break room. He requested that the Council receive and disclose a detailed accounting of the expenditures. 2. A proposed ordinance on revisions to the City of Janesville Subdivision Ordinance requiring grading and drainage plans for preliminary plats, preliminary certified survey maps, final plats, and final certified survey maps; and digital submission of preliminary plats and preliminary certified survey maps received its second reading and public hearing. The hearing was opened. Richard Frank, 1119 Elida Street, requested that proposed ordinances be published prior to City Council meetings to allow for better citizen participation. He asked multiple questions about the grading and drainage provisions of the proposed ordinance. The public hearing was closed. The Administration responded to Mr. Frank's questions. Councilmember Tom Wellnitz moved to adopt said ordinance, seconded by Councilmember Addie and passed unanimously. (File Ord. No. 2006-325) 3. A proposed ordinance rezoning property located south of Burbank Avenue along the southerly extension of South Terrace Street from R3 and B2 to R1 received its second reading and public hearing. No one spoke at the public hearing. Council President Tim Wellnitz continued the public hearing to January 22, 2007. (File Ord. No. 2006-354) NEW BUSINESS 1. City Council review of Municipal Building break room renovations. Jack Messer, Director of Public Works, presented information concerning the break room renovations. He stated that Council relations were very important to the Administration and apologized if there was not sufficient information provided to the Council about the scope of the project. The break room was 40 years old and needed extensive work. The budget for this project was $41,500. The construction costs ($20, 075) included asbestos removal, electrical, plumbing, cabinets, painting and flooring. In addition, new furnishings ($8,485) and appliances ($3,707) were purchased. The remaining funds will be used to repair the front of the Municipal Building. City Manager Steve Sheiffer stated that the Administration would provide Mr. Lembrich with a detailed accounting of the break room costs. 2. Action on a potential Spring Primary for Janesville City Council on February 20,2007. Jean Ann Wulf, City Clerk-Treasurer, informed the Council that only eight candidates had made ballot status. Therefore, a primary was not necessary and no action was required. 3. A proposed resolution for Amendment No. #1 to the project plan for TIF District No. 26 was referred to Plan Commission, and scheduled for public hearing on February 12, 2007. (File Res. No. 2007-366) 4. A proposed ordinance amending the Building Code to add installation of windows as a permit item for properties located within a Historic Overlay District was introduced, referred to Plan Commission, and scheduled for public hearing on February 12, 2007. (File Ord. No. 2007-358) 5. A proposed ordinance rezoning property located at 202 McKinley Street from B6 to 02 was introduced, referred to Plan Commission, and scheduled for public hearing on February 12, 2007. (File Ord. No. 2007-357) 6. A proposed ordinance annexing property located at 2020 East Delavan Drive was introduced and scheduled for public hearing on February 12, 2007. (File Ord. No. 2007-355) 7. A proposed ordinance zoning property located at 2020 East Delavan Drive to R1 upon annexation, was introduced, referred to Plan Commission, and scheduled for public hearing on February 12, 2007. (File Ord. No. 2007-356) 8. Requests and comments from the public on matters which can be affected by Council action. Richard Frank, 1119 Elida Street, expressed his opinions on a mayoral form of government. 9. Matters not on the Agenda. City Manager Steve Sheiffer invited the Council to the City Employee Holiday party and the Forward Janesville awards luncheon. Council President Tim Wellnitz scheduled a Council Study Session for February 28,2007 at 6:30 p.m. 10. Councilmember Williams moved to convene into closed session, pursuant to Wisconsin Statute Section 19.85(1)( e) for the purpose of deliberating or negotiating the purchase and/or sale of public properties, the investing of public funds or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, specifically setting the negotiation terms and conditions for a potential TIF 14 industrial site sale and development agreement. The motion was seconded by Councilmember Tom Wellnitz and passed unanimously.
