Regular meeting of the City Council of the City of Janesville held in the Municipal Building on
July 24,2006. The meeting was called to order by Council President Tim Wellnitz at 7:00 p.m.
He then led Council in the Pledge of Allegiance.
Present: Council President Tim Wellnitz, Councilmembers Brunner, Williams, Tom Wellnitz,
Brien, DeGarmo and Addie.
CONSENT AGENDA
Minutes of the regular meeting of July 10, 2006.
Licenses; and Recommendations of the Alcohol License Advisory Committee.
Financial statement for the month of June, 2006.
Action on a motion to approve final Certified Survey Map #06009-C, Sturbridge Development, 1
lot on John Paul Road.
Council President Tim Wellnitz stated the Consent Agenda would be approved if there were no
objections. There were none.
A proposed resolution recognizing the late Mr. Lew Mittness for his service to the Janesville
community. Council member Brien moved to adopt said resolution, seconded by Council member
DeGarmo and passed unanimously. (File Res. No. 2006-323) Mrs. Mittness and her grandson
thanked Council for the honor.
Citizen presentation on the development of the green space between Hedberg Public Library
and Marshall Apartments. Coral Swanson, Park Committee Chair, and Jon Wangerin, Park
Committee Member, presented plans for developing this area. Council member DeGarmo moved
to approve said project subject to approval of specific plans by the Plan Commission and City
Manager, seconded by Council member Brunner and passed unanimously.
OLD BUSINESS
1. Requests and comments from the public regarding items on the Agenda not requiring a
public hearing. There were none.
2. A proposed ordinance prohibiting the use of helicopters and other aircraft for construction
or construction related purposes between the hours of 8:00 p.m. and 8:00 a.m., received its
second reading and public hearing. Andreah Briarmoon, 339 S. Locust Street, asked that the
words "construction or construction purposes" be deleted from the ordinance. Bill McCoy, 1326
Putnam Avenue, asked that the proposed ordinance be made more stringent. The hearing was
closed. Council member Brien stated for the record he was responsible for working with General
Motors during the 1990s to reschedule early morning helicopter drops. Council member Brien
moved to adopt said ordinance, seconded by Council member Tom Wellnitz and passed
unanimously. (File Res. No. 2006-335)
Council President Tim Wellnitz combined the second reading and public hearing on items 3 &
4.
3. & 4. Proposed ordinances annexing (2006-333) and zoning (2006-334) property located
north of USH 14 and west of Town Hall Road received their second reading and public hearing.
No one spoke at the hearing. Council member Williams moved to adopt said ordinances,
seconded by Council member Tom Wellnitz, and passed unanimously. (File Ord. Nos. 2006-
333 & 2006-334)
5. Public hearing and action on a proposed final resolution for Public Works projects
included in Bid Schedule "F" - 2006. The public hearing was opened. No one spoke at the
hearing. Council President Tim Wellnitz postponed action and continued the public hearing to
August 14, 2006. (File Res. No. 2006-324)
NEW BUSINESS
1. Public hearing and action on the demolition of the shed located at 1402 West Court
Street. The public hearing was opened. Speaking in favor of demolition were: Peter Kealey, 21
South Jackson Street; Don Allison, 731 North Garfield Avenue; Anita Johnson, 243 Ba-wood
Lane; Bill Truman, 360 Johnson Street; Bruce Pierson, 3220 Royal Road and Steve Douglas,
409 East Milwaukee Street. Speaking in opposition to demolition were: Richard Frank, 1119
Elida Street; AI Lembrich, 541 Miller Avenue; Muriel Baumgartner, 1735 South Osborne Avenue;
William Linsey, 5734 South Highway 51; Lori and Tom Peterson, 502 South Orchard Street;
Mike Becker, 220 South Academy Street; Jerry Ginner, 1715 South River Road; Don Robson,
215 Linn Street; Janet LaBrie, 320 East Holmes Street; Bill McCoy, 1326 Putnam Avenue;
Jeanne Zillmer, 5734 South Highway 51; John Sathre, 3438 Spruce Street; Mark Fuller, 320
East Holmes Street and Andreah Briarmoon, 339 South Locust Street. The hearing was closed.
Council member Williams moved to raze the shed at 1402 East Court Street as soon as possible,
seconded by Council member DeGarmo and passed by the following vote: Aye: Council
President Tim Wellnitz, Councilmembers Brien, Tom Wellnitz, Williams, Brunner and DeGarmo.
Nay: Council member Addie.
2. Requests and comments from the public on matters which can be affected by Council
action. Bill Truman, 360 Johnson Street, spoke about abandoned vehicles on West Court Street
and Rockport Road. He also stated 3 vehicles have been sitting in the new Armory parking lot
for extended periods of time and questioned curb and gutter cuts in this lot. Mr. Truman asked if
Council could have a "blackout button" to cut off speakers who use offensive words and raise
their voices.
3. Matters not on the Agenda.
Council member Williams stated for the record he is not in favor of discontinuing JATV 12.
Council member Addie requested the administration research an existing ordinance that
regulates weekday ski show rehearsals with loud music. Council member Brien refuted several
statements for the record regarding his home that aired on the JATV 12 C.A.R.D. program.
Council member Tom Wellnitz requested information on allowing golf carts with handicapped
stickers to drive on the bike trails. Council member Brunner stated that the number of dogs off
leash on the bike trails is increasing and requested an update on the Home Depot's compliance
with the outdoor display/storage ordinance.
4. Adjournment. There being no further business, Council adjourned at 9:35 p.m.
