RESOLUTION NO. 2006-356
A resolution releasing a utility easement on property located at 1239 Milton Avenue.
WHEREAS, a 4-foot wide utility easement was dedicated within Lot 21 of the Northgate Park
Subdivision to the City of Janesville, Rock County, Wisconsin.
WHEREAS, said utility easement conflicts with proposed development plans for the land area
surrounding said utility easement on Lot 21; and
WHEREAS, said owner requests that the City release its rights to the existing easement; and
WHEREAS, the City Council finds the release of the existing easement consistent with the
public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF
JANESVILLE that the City of Janesville hereby releases all rights to the following described
easement:
Located in NE % of Section 30 of T.3N., R.13E. of the 4th P.M., Harmony Township, Rock
County, Wisconsin, described as follows:
A 4-foot wide utility easement within Lot 21 of the Northgate Park to the City of Janesville, Rock
County, Wisconsin, as recorded on September 22, 1953 in Volume 16, Page 16 of Plats, as
Document Number 545213 in the Office of the Register of Deeds for Rock County, Wisconsin.
BE IT FURTHER RESOLVED that said easement released by the City of Janesville does not
relinquish any inherent rights that other utility companies serving the area may have to use said
easement.
BE IT FURTHER RESOLVED that upon adoption of this resolution, the City Clerk is directed to
record a certified copy of this resolution with the Register of Deeds of Rock County, Wisconsin,
thus granting the easement release as herein described.
