RESOLUTION NO. 2006-339
A resolution releasing utility easements on property located at 3916
Huntington Avenue.
WHEREAS, a 12-foot wide utility easement was dedicated within Lot 9 of the
Huntington Place subdivision to the City of Janesville, Rock County, Wisconsin,
as recorded on May 1, 2001 in Volume 32, Pages 514 and 515 of Plats, as
Document Number 1491878 in the Office of the Register of Deeds for Rock
County, Wisconsin.
WHEREAS, said utility easements conflict with proposed development plans for
the land area surrounding said utility easements on Lot 9; and
WHEREAS, the owner of the property on which the easement is located will
convey a new utility easement to replace said existing easement located on Lot 9
to the east of the current location; and
WHEREAS, said owner requests that the City release its rights to the existing
easement upon conveyance of the relocated easement; and
WHEREAS, the owner will convey to the City of Janesville a new 12 foot wide
utility easement on Lot 9 approximately 30 feet to the east of the existing
easement; and
WHEREAS, the City Council finds the release of the existing easement in
exchange for the granting of new easements in the desired location consistent
with the public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE
CITY OF JANESVILLE that the City of Janesville hereby releases all rights to the
following described easement:
Lot 9 of Huntington Place in the City of Janesville, Rock County,
Wisconsin commencing at the most SE corner of Lot 9 of said Huntington
Place; thence N.66°56'20"w along the Southwesterly line of said Lot,
164.0 feet; thence N.23°03'40"E 1 0.0 feet to the place beginning for said
utility easement to be released; thence continuing N.23°03'40"E. 110.0
feet to the Northeasterly line of said Lot and also being at the end of this
description (being 6 ft. either side of said centerline).
BE IT FURTHER RESOLVED that said easement released by the City of
Janesville does not relinquish any inherent rights that other utility companies
serving the area my a have to use said easement.
BE IT FURTHER RESOLVED that upon adoption of this resolution and receipt of
the necessary documentation creating the new easements in the desired
locations, the City Clerk is directed to record a certified copy of this resolution
with the Register of Deeds of Rock County, Wisconsin, thus granting the
easement release as herein described.
