RESOLUTION NO. 2006-337
A resolution authorizing the release of a 10-foot wide electrical utility
easement to located on the north side of the city's North Zone Reservoir
Site.
WHEREAS, the City of Janesville, Rock County, Wisconsin, is the owner of
property located in the Northeast Quarter Section (NE %) of 22, all in Town 3
North, Range 12 East, Town of Janesville, Rock County; and
WHEREAS, an easement for the right to construct, place, replace, maintain,
remove and operate therein electrical underground wires was conveyed to the
City of Janesville on April 22, 1982 recorded on Card #103, Image #154, as
Recording Document 952109 in the office or Register of Deeds for Rock County,
Wisconsin; and
WHEREAS, the City Engineering and Planning Service Departments have
determined that this easement will no longer be necessary with the proposed
development of the surrounding land area thus allowing for the continued
alignment of electric utility service and transmission; and
WHEREAS, on 21 August 2006 the Plan Commission reviewed the proposed
release of the 10-foot electric utility easement and found them to be consistent
with city plans; and
WHEREAS, the City Council finds the release of said existing 10-foot wide
electrical utility easement is not contrary to the public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE
CITY OF JANESVILLE that the following described easement is hereby
released:
Northeast Quarter Section (NE %) of Section 22, all in Town 3 North, Range 12
East, Town of Janesville, Rock County, Wisconsin. Said interest arising due to
utility easement recorded on April 22, 1982 recorded on Card #103, Image #154,
as Recording Document 952109 in the office or Register of Deeds for Rock
County, Wisconsin.
BE IT FURTHER RESOLVED THAT upon adoption of this resolution and receipt
of signed easements and the recording of the Arbor Ridge subdivision plat
dedicating replacement easements for public utilities, the City Clerk is directed to
record a certified copy of this resolution with the Register of Deeds of Rock
County, Wisconsin, thus granting the easement release of the easement herein
described.
