RESOLUTION NO. 2006-336
A resolution authorizing the release of a 60-foot wide ingress/egress and
water main easement extending from the north side of the city's North Zone
Reservoir Site to Ridgewood Drive.
WHEREAS, the City of Janesville, Rock County, Wisconsin, is the owner of
property located in the Northeast Quarter Section (NE ~) of Section 22, all in
Town 3 North, Range 12 East, Town of Janesville, Rock County, Wisconsin; and
WHEREAS, an easement for the protection and maintenance of a 24 inch water
main and ingress/egress access to the City's North Zone Reservoir site was
conveyed to the City of Janesville on July 30, 1980 on Card #52, Image #66-70,
as Document Number 926738 in the office of the Register of Deeds for Rock
County, Wisconsin; and
WHEREAS, the City Engineering and Planning Service Departments have
determined that this easement can be released and reestablished through plat
and other dedication instruments to a lesser scope; and
WHEREAS, on 21 August 2006 the Plan Commission reviewed the proposed
easement release of the 60 foot curvilinear ingress/egress and water main
easement while still providing for maintenance and protection to the existing 24-
inch water main through land dedication and other conveyance instruments upon
final plat approval; and
WHEREAS, the City Council finds the release of said existing ingress/egress and
water utility easement is not contrary to the public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE
CITY OF JANESVILLE that the following described easement is hereby
released:
Northeast Quarter Section (NE ~) of Section 22, all in Town 3 North, Range 12
East, Town of Janesville, Rock County, Wisconsin. Said interest arising due to
utility easement recorded on July 30, 1980 on Card #52, Image #66-70, as
Document Number 926738 in the office of the Register of Deeds for Rock
County, Wisconsin.
BE IT FURTHER RESOLVED THAT upon adoption of this resolution and receipt
of signed easements and the recording of the Arbor Ridge subdivision plat
dedicating replacement easements for public utilities, the City Clerk is directed to
record a certified copy of this resolution with the Register of Deeds of Rock
County, Wisconsin, thus granting the easement release of the easement herein
described.
