2006-322 5 July 2006 Page (1) of (2) CITY OF JANESVILLE RESOLUTION NO. 2006-322 A Resolution authorizing the City Manager to proceed with the sale of surplus City lands located adjacent to 1-90 and U.S. Highway 14. WHEREAS, the City of Janesville owns the following described parcels of real property: Part of the SE% of Section 17, T.3N., R.13E., of the 4th Prime Meridian, City of Janesville, Rock County, Wisconsin. DESCRIBED AS FOLLOWS: Beginning at the southernmost corner of Lot 1 of Certified Survey Map #1384905 as recorded with the Rock County Register of Deeds in Volume 21, pages 355-357; thence S.6°18'05"E., 52.57 feet; thence S.51°15'E. , 336.83 feet; thence S.22°00'55"W., 57.72 feet; thence N.6r59'05"W. along the north line of an access road, 18.60 feet to a point of curve; thence Northwesterly continuing along said north line along a curve to the right 173.56, having a radius of 660 feet and a chord bearing N.60027'05''W., 173.06 feet; thence Northwesterly continuing along said north line, along a curve to the right, 218.69 feet, having a radius of 300 feet and a chord bearing N.32°02'05"W., 213.88 feet; thence N38°41 '55"E 55.05 feet to the Point of Beginning. WHEREAS, the property consists of 28,197 S. F. of land located adjacent to 1-90 and U.S. Highway 14 deemed unnecessary to be retained in City ownership; and WHEREAS, the City of Janesville will retain easements on the property for the use of utilities and stormwater purposes and have access to and from the easement across adjacent properties; and WHEREAS, the Janesville Plan Commission has reviewed the matter at its meeting held on July 5, 2006 and has recommended that this property be declared surplus land and that the City Council authorize the City Manager to proceed with the sale of this property, but has not reviewed the financial aspects of this transaction; and WHEREAS, the Common Council of the City of Janesville does hereby find that this property is surplus and is no longer needed for City purposes and that the proposed transaction is to the benefit and in the best interest of the citizens and the City of Janesville. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Janesville, that it hereby authorizes and directs the City Manager and the City Clerk to negotiate, enter into and execute, on behalf of the City of Janesville, the sale of such property; and to negotiate and execute such documents, papers and forms as may from time to time be necessary and/or desirable to effectuate such transactions and the intent of this Resolution as the City Manager may decide. 5 July 2006 Page (2) of (2) CITY OF JANESVILLE RESOLUTION NO. 2006-322 BE IT FURTHER RESOLVED, that the City Manager is hereby authorized to take whatever other actions or to make whatever other minor changes that may be necessary to effectuate this land transaction. BE IT FURTHER RESOLVED, that the City retains an easement over the entire property described above for the use of utilities and stormwater purposes and shall be granted access to and from the easement area across adjacent properties.
