Resolution No. 2006-306
A Resolution Authorizing the City to Enter Into a Lease with Community Action,
Inc. of Rock and Walworth Counties for the Property Located at 200 W. Milwaukee
Street, Janesville, Wisconsin.
WHEREAS, the City of Janesville owns an office building located at 200 W. Milwaukee
Street, Janesville, Wisconsin; and
WHEREAS, that building became vacant and surplus in March, 2006, when the
Neighborhood Services Department relocated from that building into the Municipal
Building; and
WHEREAS, the City of Janesville solicited competitive proposals by advertising the
availability of this building for lease in the Janesville Gazette as well as sending the
Request for Proposals to known interested parties and local realtors; and
WHEREAS, Community Action, Inc. of Rock and Walworth Counties (Community
Action) responded to that Request for Proposals; and
WHEREAS, the specific terms, payments and conditions thereto have been negotiated
by and between the City Administration and Community Action and set into a written
document called the Lease, a true and correct photocopy of which is attached hereto
and incorporated herein as if fully set forth verbatim; and
WHEREAS, such Lease terms and conditions therein are permitted by law and the
Common Council is empowered to enter into such Lease, pursuant to sections 62.11 (5),
62.22, 62.23 and other pertinent provisions of the Wisconsin Statutes and law; and
WHEREAS, the Plan Commission of the City of Janesville reviewed the lease of this
building on the 15th day of May, 2006 and found it to be consistent with City plans; and
WHEREAS, entering into said Lease is in the best interest of the City of Janesville and
of benefit to the community and its residents, businesses, and taxpayers.
NOW, THEREFORE, BE IT RESOLVED, BY THE Common Council of the City of
Janesville that they hereby approve and authorize the City Manager to execute and
enter into, on behalf of the City of Janesville, the attached Lease with Community
Action, Inc. of Rock and Walworth Counties; and
BE IT FURTHER RESOLVED, that the City Manager is hereby authorized to negotiate
and execute such documents, papers, agreements, amendments and forms, to take
whatever other actions and to make whatever other changes to the Lease and such
other documents, papers, agreements, amendments and forms as the City Manager
may, from time to time, find necessary, desirable and/or beneficial to effectuate the
Lease and/or the intent of this Resolution on the City's behalf.
