2006-305 REVISED FILE RESOLUTION NO. 2006-305 A resolution vacating a portion ot East Rotamer Road right-ot-way. WHEREAS, the street right-of-way portion hereinafter designated and previously dedicated for street purposes is hereby determined to be no longer needed for public use, and therefore, the public interest requires the vacation of such street right-of-way portion; and WHEREAS, it has been determined that the traffic flow will not be impeded by the vacation of such street right-of-way portion; and WHEREAS, the public hearing was held on vacation of such street right-of-way portion and notice required by Wisconsin Statutes 66.1003 has been timely published and served; and NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the following described street right-of-way portions be and are hereby vacated and discontinued pursuant to 66.1003 and 62.22(lm), Wisconsin Statutes: Part of the SW% of Section 8, T.3N., R.13E., of the 4th Prime Meridian, City of Janesville, Rock County, Wisconsin. DESCRIBED AS FOLLOWS: Beginning at the southernmost corner of Lot 6, Fox Hills Estates; thence South 42°45'15" West, a distance of 73 feet to the south right-of-way line of Rotamer Road; thence North 4r44'45" West, along the south line of said right-of-way, a distance of 453.95 feet; thence North 42°45'15" East, a distance of 73 feet to the north right-of-way line of Rotamer Road; thence South 4r44'45" East, along the north line of said right-of-way, a distance of 453.95 feet to the Point of Beginning. BE IT FURTHER RESOLVED that the City of Janesville expressly retains an easement for utility purposes over the southeasterly 50 feet of that area herein described; and BE IT FURTHER RESOLVED that the City also retains a 30-foot wide bike trail/pedestrian walkway easement centered on the right-of-way area herein described; and BE IT FURTHER RESOLVED that the adjoining residential properties north of the proposed street vacation should be aware that in the future the City may construct a bikeway/pedestrian walkway connection within the bike trail/pedestrian walkway easement area.
