RESOLUTION # 2006-257
A RESOLUTION AUTHORIZING THE CITY MANAGER
TO ACCEPT THE TRANSFER OF LAND FOR PUBLIC PURPOSES
WHEREAS, the City of Janesville desires to build a bike trail connector from the Highway
11 trail north to Prairie Knoll Park; and
WHEREAS, $90,000 was approved in the 2005 note issue for this purpose; and
WHEREAS, additional land is needed along the east side of South Oakhill Avenue to
facilitate the trail construction; and
WHEREAS, the adjacent property owner MacFarlane Pheasants, Inc., et.a!., has
executed a deed to transfer ownership of 6,580 square feet of land to the City for public
purposes; and
WHEREAS, the City agrees to relocate the fence line along our common property line.
WHEREAS, the Janesville Plan Commission reviewed this proposed acquisition and
found it to be consistent with the City's long range plans and with the City's Bike Trail Master
Plan; and
WHEREAS, the acquisition of this property is in the best interest of the City and of benefit
to the Committee.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of
Janesville that they hereby authorize the City Manager, and/or his designee, to acquire such
property from MacFarlane Pheasants, Inc., et.a!., on behalf of the City as the City Manager may
deem necessary or desirable to effectuate the intent of this resolution; and
BE IT FURTHER RESOLVED, that the City of Janesville may perform force account
work, will maintain the completed project in an attractive, inviting and safe manner, will keep the
facility open to the general public during all reasonable hours consistent with the type of facility;
and
BE IT FURTHER RESOLVED, that the City Manager and/or his designee may from time
to time, negotiate, draft, amend, execute and enter into such changes and other documents to
the property acquisition documents, contracts and agreements, and take such other action as
the City Manager may deem necessary or desirable to effectuate the intent of this resolution.
