2006-326 ORDINANCE NO. 2006 - 326 An ordinance updating various user and license fees, with penalties for violations thereof as set forth in the applicable ordinance chapters. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: AMUSEMENT CENTER SECTION I. Section 5.04.010 A. 1. of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "5.04.010 A. 1. (a) Amusement center license (Section 5.08.020 8.) $200 per establishment 5 or more devices (b) $30 per device. Every Amusement Device requires a separate license. Every owner and possessor of an Amusement Device shall pay a $30 per device annual license fee for the first 20 Amusement Devices per premises, with a maximum annual aggregate per device license fee of $600 per premises. The per device annual license fee shall be paid by all owners and possessors of Amusement Devices whether or not the premises constitutes an Amusement Center, and shall be paid in addition to the Amusement Center license fee, as applicable. (c) Such fees shall not be apportioned, regardless of the date on which such license may be issued. " SECTION II. Section 5.12.012 of the Code of General Ordinances of the City of Janesville is hereby created to read as follows: "5.12.012 Amusement Devices - Licensing. Every Amusement Device in the City when used commercially requires a separate annual Amusement Device License. Every owner and possessor of an Amusement Device shall pay a per device annual license fee for the first 20 Amusement Devices per premises. The amount of the fee and any maximum annual aggregate per device license fee per premises shall be in the amount(s) set forth in JGO 5.04.010 A. 1., as from time to time amended or renumbered. The per device annual license fee shall be paid by all owners and possessors of Amusement Devices whether or not the premises constitutes an Amusement Center, and shall be paid in addition to the Amusement Center license fee, as applicable. BOWLING CENTER SECTION III. Section 5.04.010 A. 6. of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "5.04.010 A. 6. Pool and billiard halls, bowling centers (Sections 5.72.010-5.72.120) a. Pool and billiard tables each $ 8.00 per year b. Bowling centers, for each bowling lane ~ $20.00 per year Such fee shall not be apportioned, regardless of the date on which such license may be issued" PAWNBROKER/SECOND HAND ARTICLE and JEWELRY DEALER/JUNK DEALER SECTION IV. Section 5.52.010 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "5.52.010 License-Required No person shall do business as a pawnbroker, junk dealer, dealer in secondhand goods, secondhand article dealer, secondhand jewelry dealer, secondhand article dealer mall, flea market, or secondhand dealer in junk, wares or merchandise as those terms are defined in the applicable state laws adopted hereby and incorporated herein as set forth below, without having first obtained and holding a valid license therefore from the City." SECTION V. Section 5.52.012 of the Code of General Ordinances of the City of Janesville is hereby created to read as follows: "5.52.012 Adoption of State Laws - More Stringent Laws Govern A. Incorporated herein by reference and made a part of this chapter as if fully set forth verbatim are Wis. Stats. §§ 134.71 and 134.695, including but not limited to the fee schedule set by state law in § 134.71(11), all as from time to time amended or renumbered. Any and all acts required to be performed or prohibited by any statutes so incorporated by reference is/are required or prohibited by this chapter. Any future amendments, revisions, or modifications of the statutes incorporated by this chapter are also adopted and incorporated as a part of this chapter. B. The more stringent provision set forth in this chapter or that set forth in the incorporated state law(s) shall always take precedence and govern, notwithstanding any conflict, inconsistency or ambiguity to the contrary. The intent is to at all times render this chapter in full force and effect and in conformity with Wis. Stats.§ 134.71(14), as from time to time amended or renumbered." SECTION VI. Section 5.04.010 N. of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "5.04.010 N. Junk dealer, secondhand dealer, secondhand jewelry dealer, pawnbroker, flea market, secondhand article dealer mall or related activity as defined in applicable state law (Sections 5.52.010- 5.52.080) (See s. 134.71 for definitions and s. 134.71(11) for fees) (For bond see s. 134.71(7), et al.) 1. Pawnbroker's license $210.00 per year with $500 bond 2. Secondhand article dealer's license $27.50 per year with $500 bond 3. Secondhand jewelry dealer's license $30.00 per year with $500 bond 4. Secondhand article dealer mall license $165 per year with required bond 5. Flea Market license $165 per year with required bond 6. All other secondhand dealers $27.50 per year with $500 bond 7. Junk dealers (City definition) $27.50 per year with $500 bond Such fee shall not be apportioned, regardless ofthe date on which such license may be issued." SOLICITORS/DIRECT SELLERS SECTION VII. Section 5.04.010 P. of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "5.04.010 P. Direct sellers (Sections 5.68.010-5.68.120) $+§. $100 for a period up to one year." CLASS A FMB (Beer) LICENSE ANNUAL (Liquor Store) SECTION VIII. Section 5.04.010 K. 1. of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "5.04.010 K. 1. Class A retail license (Chapter 5.06) (See s. 125.25(4)) $225 per year" COMMUNITY DEVELOPMENT DEPARTMENT FEE SCHEDULE Planning Services Fee Schedule SECTION IX. Section 18.24.090 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "18.24.090 Fee Schedule. A. The fee schedule(l) is as follows: Condition Use Permit (PUD) Conditional Use Permit (Variable) o to 10,000 sq ft or less than 1 acre 10,000 to 25,000 sq ft or 1 to 5 acres Greater than 25,000 sq ft or 5 acres Conditional Use Amendments Application for Rezoning (Variable) Rl, R2, Conservancy or Agriculture Multi-Family, Office, Comm. or Indust.(2) Zoning Ordinance Amendment Application for Change of Nonconforming Use Filing of Appeal to Zoning Board of Appeals (Variable) 1. (2) Base fee used for Rezoning of multi-family, office, commercial, or industrial; sites with 10 acres or above have $50 added charge per acre (up to $1,000 maximum)" B. Fee Schedule Review. The fees as listed above shall be reviewed on at least a five-year cycle beginning on January 1, 2007. Subdivision (Land Division) Fees SECTION X. Section 17.16.180 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "17.16.180 Fees. A. The subdivider shall pay, upon filing the preliminary certified survey, the sum of$125.00 $150.00 and the sum of$75.00 $150.00 upon the filing of a final certified survey map. B. The subdivider shall pay, upon filing the preliminary plat, the sum of$250.00 $500.00 or $15 per lot whichever is greater, and upon the filing of a final plat, the sum of$150.00 $250.00 or $10 per acre whichever is greater. C. Any individual who applies for a release of a utility easement shall pay a sum of $50.00 $150.00 for processing such a request. D. Any individual who applies for the vacation of a street or alley or other right-of-way shall pay a sum of $50.00 $250.00 for processing such a request. E. The fees as listed above shall be reviewed on at least a five-year cycle beginning on August 1999. F. The above fees shall take effect on January 1,2007." SECTION XI. Sections 15.01.140 I. All provisions, increases and other amendments set forth above in this File Ordinance shall take effect January 1,2007, the public health, welfare, safety, peace and good order so requiring.
