2006-325 >~ ORDINANCE NO. 2006-325 An ordinance amending various provisions of Chapter 17.12 (Preliminary Plat) and Chapter 17.16 (Final Plats and Certified Surveys) of the Code of General Ordinances of the City of Janesville, with penalties for violations thereof, together with the cost of prosecution, with remedies upon default of forfeiture payment, and injunctive relief, all in the manner set forth in Section 17.56.010 of the Code of General Ordinances of the City of Janesville. THE COMMON COUNCil OF THE CITY OF JANESVlllE DO ORDAIN AS FOllOWS: SECTION I. Section 17.12.010 (B) of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "B. When requested by the Plan Commission as being necessary, the subdivider must provide a topographic map of the area to be platted, with a two-foot contour interval. Contours shall be referred to the City's established datum as identified bv the City EnQineer." SECTION II. Section 17.12.020 (B) of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "B. A diQitallv rendered sketch plan showing the proposed layout of streets, lots and other features in relation to existing conditions. The sketch must be drawn in the coordinate system approved bv the City EnQineer and submitted on disk or via electronic transfer in a CADD or GIS format approved bv the City of Janesville." SECTION III. Section 17.12.030 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "17.12.030 Drawing-Requirements. The preliminary plat shall be submitted as a diQital renderinQ prepared on reproducible paper or film not to exceed thirty-six (36") inches in width and a map scale of not more than two hundred (200') feet to the inch. Where more than one paqe is used to show the entire area to be Platted at the required scale. then a sinqle paQe shall be submitted at any scale that shows the entire area to be platted. The preliminary plat shall show correctly on its face the information listed below in subparaQraphs A. Band C. A. DESCRIPTION 1. Date, Qraphic scale and north arrow: 2. The proposed subdivision name, which shall not duplicate the name of any plat previously recorded in Rock County; 3. The name and address and telephone number of the owner, the subdivider and the surveyors preparing the plat; 1 4. Location of the proposed subdivision by government lot quarter- quarter section, section, township, range and county; 5. A small-scale drawing of the section or governmental subdivision of the section in which the subdivision lies, with the location of the subdivision indicated thereon; 6. Location map showinQ the relationship between the preliminary plat and surroundinQ area; B. Existinq Conditions 1. Location and names of adjacent subdivisions and the owners of adjoining parcels of unsubdivided land; 2. ExistinQ land use and zoning on land adjacent to the subdivision; 3. Location, width, elevations and names of all existing platted streets, alleys or other public ways and easements, railroad and utility rights-of-way, parks, cemeteries, water-courses, natural springs, drainage ditches, permanent buildings, bridges, and other pertinent data as determined by the plan commission. This may include large trees that may have a bearing on the location of the streets; 4. Tvpe and width of any adjacent existinQ street pavements. tOQether with any leQallv established centerline elevations for streets located outside the City limits: 5. The water elevations of adjoining bodies of water at the date of the survey, and known or determined high and low water elevations and boundaries of the 1 OO-vear flood-frinQe. floodwav. and/or Qeneral floodplain. All elevations shall be referred to the City's established datum as identified bv the City EnQineer; C. PROPOSED IMPROVEMENTS 1. The length of the exterior boundaries of the subdivision; 2. Lavout and dimensions of and area of all lots. proposed lot and block numbers. and number of dwellinQ units if different than number of lots: 3. Note indicatinQ the on-site location and elevation of the plat benchmark referred to the City's established datum as identified bv the City Enqineer: 4. Layout, approximate dimensions and names (as applicable) of all new streets and rights-of-way, such as alleys, highways, easements for sewers, water mains and other public utilities; 5. Location and approximate dimensions and size of any sites to be reserved or dedicated for schools. parks. plaVQrounds. Qreenbelts. drainaQewavs. or other public use or open space: 6. Location and approximate dimensions and size of any sites reserved for the private use of subdivision or condominium development residents and the conditions and terms of all applicable deed restrictions applvinQ to these sites: 7. Approximate radii of all curves and length of tangents; 8. Contours at vertical intervals of two feet as required by the City Engineer; 2 9. The boundaries of each phase of plattinQ for the proposed subdivision." SECTION IV. Section 17.12.035 of the Code of General Ordinances of the City of Janesville is hereby created to read as follows: "17.12.035 Preliminary GradinQ and DrainaQe Plan. The preliminary QradinQ plan shall be submitted as a diqital renderinQ prepared on reproducible paper or film not to exceed thirty-six (36") inches in width and a map scale of not more than two hundred (200') feet to the inch. The preliminary qradinQ and drainaQe plan must include: A. spot elevations. B. C. D. Elevation of existinQ structures. existinq qround contours and/or Off-site drainaQe basins that flow throuQh the plat. ExistinQ and proposed reQional and local flood elevations. Arrows indicatinQ the direction of proposed overland drainaQe flow. E. DrainaQe easements as necessary to accommodate the QradinQ plan. F. Location and approximate confiQuration of proposed on-site drainaqe basins after QradinQ subdivision. G. Appropriate storm water calculations to demonstrate that the facilities identified in item F are sufficient to meet all requirements of the City of Janesville Code of General Ordinances. Chapter 15.06. H. Plats for lands located outside the City of Janesville and within the City's extraterritorial plat review jurisdiction area are not subject to the requirements above." SECTION V. Chapter 17.16.020 (D) of the Code of General Ordinances of the City of Janesville is hereby created to read as follows: "D. Master Site GradinQ and DrainaQe Plan. The final plat must include a final Master Site GradinQ Plan which shall contain information as outlined in the Master Site GradinQ Plan Handbook on file in the City Enqineerinq Department. The subdivider shall submit a COpy of the Master Site GradinQ and Drainaqe Plan to the City as a diQital file in a format specified bv the City EnQineer." E. Plats and certified survey maps for lands located outside the City of Janesville and within the City's extraterritorial plat review jurisdiction area are not subject to the requirements set forth in Section 17.16.020 (D)." 3 SECTION VI. Chapter 17.16.040 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "17.16.040 Final plat--Copies and filing fee submitted to City Planner-- Review_procedure. Thirteen copies of the final plat and master site QradinQ and drainaQe plan including the required filing fee shall be submitted to the City Planner at least twelve days before the final plat is scheduled to be reviewed by the City Plan Commission. The applicant shall also submit a COpy of the final plat in diQital format satisfactory to the City Enqineer. If the final plat is not submitted within six months of the last approval of the preliminary plat, the Plan Commission may refuse to approve the final plat. (Ord. 74-424 §2, 1974; Prior code §24.05(3)(a)). SECTION VII. Chapter 17.16.050 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "17.16.050 Final plat--Approval and rejection procedure. The Plan Commission shall refer the final plat with its recommendation to the City Council within thirty days of its submission, unless the time is extended by the Council. The Council shall approve or reject the final plat within sixty days of its first submission to the City Clerk, unless the time is extended by agreement with the subdivider. Reasons for rejection shall be stated in the minutes of the council meeting, and a copy thereof or a written statement of such reasons shall be supplied by the subdivider. The City recommends that the subdivider or his agent shall forward copies of the plat to the Wisconsin Department of Administration under the option set forth in Section 236.12 of the Wisconsin Statutes. (Prior code §24.05(3)(b))." SECTION VIII. Chapter 17.16.070 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "17.16.070 Final plat--City to receive chronoflex and diaital copy. The surveyors, at no cost to the City, shall provide the City with a chronoflex copy of the final plat as processed by the Wisconsin Department of Administration. Upon recording, the surveyor shall submit a copy of the final plat in digital format satisfactory to the City Engineer." SECTION IX. Chapter 17.16.100 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "17.16.100 Certified survey--Preliminary. Before submitting a final certified survey for approval, the subdivider shall submit a preliminary certified survey to the City Planner if the proposed land division is located within the City. If the proposed land division is outside the City limits, the preliminary certified survey is submitted to the Rock County zoning administrator. No final certified survey will be accepted for review which has not been preceded by an approved preliminary certified survey. The applicant shall also submit a COpy of the preliminary certified survey to the City Planner in diQital format satisfactory to the City EnQineer." 4 SECTION X. Chapter 17.16.105 of the Code of General Ordinances of the City of Janesville is hereby created to read as follows: "17.16.105 Certified Survey - Preliminary Gradina and Drainaae Plan. The preliminary qradinQ plan shall be submitted as a diqital renderinQ prepared on reproducible paper or film not to exceed thirty-six (36") inches in width and a map scale of not more than two hundred (200') feet to the inch. The preliminary QradinQ and drainaQe plan must include: A. spot elevations. B. C. D. Chapter 15.06." H. Surveys for land located outside the City of Janesville and within the City's extraterritorial plat review jurisdiction area are not subject to the above requirements." SECTION XI. Chapter 17.16.115 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "17.16.115 Certified survey--Final. Before recording a final certified survey of a land division located within three miles of the City limits, it shall be approved by the City Plan Commission and the common council where dedication of land within the City is involved. Twelve copies of the final certified survey shall be submitted to the City Planner twelve days before the survey is schedule to be reviewed by the City Plan Commission. Upon recording the final certified survey, the subdivider shall submit a copy of the final plat in digital format satisfactory to the City EnQineer." SECTION XII. Section 17.16.120 of the Code of General Ordinances of the City of Janesville is hereby created to read as follows: "F. Master Site Gradinq and DrainaQe Plan. The final survey must include a final Master Site GradinQ Plan which shall contain information as outlined in the 5 Master Site GradinQ Plan Handbook on file in the City EnQineerinQ Department. The final Master Site GradinQ Plan must be submitted to the City as a diQital file in a format specified bv the City EnQineer." G. Surveys located within the City's extraterritorial plat review jurisdiction area and outside of the City of Janesville and are not subject to the requirements of Section 17.16.120 (F)." SECTION XIII. This ordinance shall take effect immediately upon adoption by the Common Council, the public health, welfare, peace, tranquility, good order, public benefit, and police power so requiring."
