An ordinance amending the O1, 02, B1, B2, B3, B4, B5 and B6 Districts of the Zoning
Ordinance to require that all Large Developments as defined by this ordinance be developed
under the conditional use provisions as said provisions are amended by this ordinance, with
a penalty and injunctive relief for a violation thereof as set forth in Section 18.28.010 of the
Code of General Ordinances of the City of Janesville.
THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS
FOLLOWS:
SECTION I. Purpose. It is hereby declared that enactment of the provisions outlined in the
following Sections of this Ordinance is essential to establish standards encouraging and insuring
that the creation of large office, institutional, business, commerce and service uses are of
sufficient quality in design and aesthetic so as to protect the health and safety of the users of such
sites, minimize impact on adjoining properties and enhance the quality of the physical
environment. Said standards are necessary considering the consumptive and disruptive affects of
poorly designed Large Developments on the physical, social, psychological and environmental
characteristics of the community. The standards and provisions are intended to:
· Protect the health and welfare of the citizenry;
· Provide a safe environment;
Improve the visual image of the city;
· Encourage physical diversity;
· Mitigate urban heat islands;
· Apply best management practices to storm water management;
· Protect existing development and improve upon it;
· Provide adequate public infrastructure and street and highway capacity;
· Encourage alternative modes of transportation and minimize the visual, physical and
environmental impacts of a motor vehicle dominated transportation system;
· Minimize light pollution and the creation of sky glow;
· Recognize the physical, environmental, social and psychological benefits of good design of all
aspects of the built environment including but not limited to building construction, site
improvement, signs and landscaping.
SECTION II. (Amends O1 and 02 Districts) Section 18.36.030.B. 1 .c.ix of the Code of General
Ordinances of the City of Janesville is hereby created to read as follows:
Large Developments as defmed by having any one of the following characteristics;
I. Any development containing a building with a ground floor footprint of
25,000 square feet or more, as measured at the building foundation.
II. Any development on a single site containing 5 or more acres or the
development of multiple sites that collectively total 5 acres or more when said
multiple sites are developed with any common link or nexus including but not
limited to shared infrastructure or physical site improvements
III. Any development that contains more than one building per site, lot or
parcel.
SECTION III. (Amends B1 District) Section 18.36.040.B. 1.c.vi. of the Code of General
Ordinances of the City of Janesville is hereby created to read as follows:
vi. Large Developments as defined by having any one of the following characteristics;
I. Any development containing a building with a ground floor footprint of
15,000 square feet or more, as measured at the building foundation.
II. Any development on a single site containing 5 or more acres or the
development of multiple sites that collectively total 5 acres or more when said
multiple sites are developed with any common link or nexus including but not
limited to shared infrastructure or physical site improvements
III. Any development that contains more than one building per site, lot or
parcel.
SECTION IV. (Amends B2 District) Section 18.36.040 B.2. c.~4f, of the Code of General
Ordinances of the City of Janesville is hereby created to read as follows:
xviii. Large
Developments as defined by having any one of the following characteristics;
I. Any development containing a building with a ground floor footprint of
25,000 square feet or more, as measured at the building foundation.
II. Any development on a single site containing 5 or more acres or the
development of multiple sites that collectively total 5 acres or more when said
multiple sites are developed with any common link or nexus including but not
limited to shared infrastructure or physical site improvements
III. Any development that contains more than one building per site, lot or
parcel.
SECTION V. (Amends B3 Distric0 Section 18.36.040.B.3.c.xxiii. of the Code of General
Ordinances of the City of Janesville is hereby created to read as follows:
xxiii. Large
Developments as defmed by having any one of the following characteristics;
I. Any development containing a building with a ground floor footprint of
25,000 square feet or more, as measured at the building foundation.
II. Any development on a single site containing 5 or more acres or the
development of multiple sites that collectively total 5 acres or more when said
multiple sites are developed with any common link or nexus including but not
limited to shared infrastructure or physical site improvements
III. Any development that contains more than one building per site, lot or
parcel.
SECTION VI. (Amends B4 District) Section 18.36.040.B.4.c.xix. of the Code of General
Ordinances of the City of Janesville is hereby created to read as follows:
Large Developments as defined by having any one of the following characteristics;
I. Any development containing a building with a ground floor footprint of
25,000 square feet or more, as measured at the building foundation.
II. Any development on a single site containing 5 or more acres or the
development of multiple sites that collectively total 5 acres or more when said
multiple sites are developed with any common link or nexus including but not
limited to shared infrastructure or physical site improvements
III. Any development that contains more than one building per site, lot or
parcel.
SECTION VII. (Amends B5 District) Section 18.36.040.B.5.c.ix. of the Code of General
Ordinances of the City of Janesville is hereby created to read as follows:
/x. Large Developments as defined by having any one of the following characteristics;
I. Any development containing a building with a ground floor footprint of
25,000 square feet or more, as measured at the building foundation.
II. Any development on a single site containing 5 or more acres or the
development of multiple sites that collectively total 5 acres or more when said
multiple sites are developed with any common link or nexus including but not
limited to shared infrastructure or physical site improvements
III. Any development that contains more than one building per site, lot or
parcel.
SECTION VIII. (Amends B6 District) Section 18.36.040.B.6.c.xvii. of the Code of General
Ordinances of the City of Janesville is hereby created to read as follows:
xvii. Large
Developments as defined by having any one of the following characteristics;
I. Any development containing a building with a ground floor footprint of
25,000 square feet or more, as measured at the building foundation.
II. Any development on a single site containing 5 or more acres or the
development of multiple sites that collectively total 5 acres or more when said
multiple sites are developed with any common link or nexus including but not
limited to shared infrastructure or physical site improvements
IH. Any development that contains more than one building per site, lot or
parcel.
SECTION IX. Section 18.24.040.G.8. of the Code of General Ordinances of the City of
Janesville is hereby created to read as follows:
8. That any Large-scale development complies with the standards of Chapter 18.34:
SECTION X. It is hereby declared to be the intention of the Common Council of the City of
Janesville that the provisions of this ordinance are severable in accordance with the following:
1. If any court of competent jurisdiction shall adjudge any provision of this title to be invalid,
such judgement shall not affect any other provision of this title not specifically included in
the judgemem.
2. If any court of competent jurisdiction shall adjudge invalid the application of any provision
of this title to a particular property, building, or structure, such judgement shall not affect
the application of said provision to any other property, building, or structure not
specifically included in the judgemem.
SECTION XI. This ordinance shall take effect immediately upon adoption by the Common
Council, the public health, welfare, peace, tranquility, good order, public benefit, and police
power so requiring.
