08-08-94PROCEEDINGS OF THE CITY COUNCIL CITY OF JANESVILLE, WISCONSIN REGULAR MEETING August 8, 1994 VOL. 45 NO. 9 APPROVED AUGUST 22, 1994 Regular meeting of the City Council of the City of Janesville, held in the Municipal Building, August 8, 1994. The meeting was called to order by Council President Noll. Present: Council President Noll, Councilmembers Stehura, Heitzman, Brien, and Schneider. Absent: Councilmembers O'Leary and Thomas. Councilmember Stehura led the Council in the Pledge of Allegiance. CONSENT AGENDA Minutes of the regular meeting held July 25, 1994. Minutes of the closed meeting held July 25, 1994. Licenses; and recommendations of the Alcohol License Advisory Committee. Action on financial gain requests from Rock County Justice Division to conduct a softball tournament on August 27, 1994 at Monterey Park; and Rock Aqua Jays to hold a duck race on the Rock River on September 5, 1994. Waiver of special assessment procedure for storm sewer and sidewalk charges for Certified Survey Map #94037-C. Action on a motion to approve Certified Survey Map Nos° 94024-C, 2 lots located at 2900-2904 Milton Avenue; and 94037-C, 2 lots located on Crosby Avenue south of Court Street. Council President Noll removed the following applications from the consent agenda: the negative recommended operators license and the Special Event license for the Janesville Jaycees. Council President Noll stated that if there were no objections, the consent agenda would be approved. There were no objections. Council President stated for the record that Robin Hughes was not in attendance at the meeting. Councilmember Stehura moved to deny an operators license to Robin Hughes, seconded by Councilmember Schneider and passed unanimously. Kelly Sands, 623 Caroline Street, representing the Janesville Jaycees, addressed Council regarding the closing time on their Special Event application. She asked it be amended to 10:00 p.m. Councilmember Stehura moved to grant a Special Event Beer & Wine Cooler license to the Janesville Jaycees with a 10:00 p.m. closing time and with tokens not to be sold after 9:30 p.m. and no beer to be sold after 9:45 p.m., seconded by Councilmember Schneider and passed unanimously. (Ail applications of licenses are on file in the office of the City Clerk and are incorporated by reference herein and may be examined upon request at all reasonable times.) OLD BUSINESS 1. Requests and comments from the public on matters which can be affected by Council action. Jim Bahler, 404 North Washington Street, addressed Council regarding fines imposed for failing to shovel sidewalks. 2. A proposed ordinance imposing a penalty for late paid snow removal violation tickets and certain late paid parking tickets received its second reading and public hearing. No one appeared. Councilmember Schneider moved to adopt said ordinance, seconded by Councilmember Heitzman. By friendly amendment, the word "working" was added to sections A, B, C, & E to read: "within five working days of issuance". Council then voted on the motion and passed unanimously. (File Ordinance No. 94-923) 3. A proposed ordinance permitting the disposal of bicycles and other found property other than by auction or sale open to the public received its second reading and public hearing. No one appeared. Councilmember Brien moved to adopt said ordinance, seconded by Councilmember Heitzman. Councilmember Stehura moved to amend said ordinance by inserting the words in section D. "For bicycles", seconded by Councilmember Heitzman and passed unanimously. Council then voted on the motion as amended and passed unanimously° (File Ordinance No. 93-937) 4. A proposed resolution vacating Edison Avenue between Beloit Avenue and Pierce Street received its public hearing. No one appeared. Councilmember Schneider moved to adopt said resolution, seconded by Councilmember Brien and passed unanimously. (File Resolution No. 94-1794) 5. A proposed resolution authorizing the City Manager to enter into an agreement with Wisconsin Department of Transportation to provide sanitary sewer service to the 1-90 rest area north of Janesville. Councilmember Heitzman moved to adopt said resolution, seconded by Council President Noll. Councilmember Stehura moved to amend said agreement section 8. C. to read "C. Granting by the Department of Natural Resources of the necessary 208 Sewer Service Boundary adjustment and approval of the City Council of any boundary adjustments." seconded by Councilmember Heitzman and passed unanimously. Council then voted on the motion and passed unanimously. (File Resolution No. 94-1814) NEW BUSINESS 1. Recommendations of the Plan Commission: A. A proposed resolution approving the final plat of Ingold's Knoll First Addition (File Resolution No. 94-1819) & B. A proposed resolution releasing and dedicating a sanitary sewer easement at 1625 North Parker Drive. (File Resolution No. 94-1817) Councilmember Schneider moved to adopt said resolutions, seconded by Councilmember Brien and passed unanimously. (File Resolution Nos. 94-1817 & 94-1819) 2. Median break on North Wright Road (New Life Assembly of God Church). Council President Noll stated that this item was withdrawn° 3. A proposed preliminary resolution for Public Works Program #3- 94. Councilmember Schneider moved to adopt said preliminary resolution and schedule the public hearing on August 22, 1994, seconded by Council President Noll and passed unanimously. (File Resolution No. 94-1803) 4. Action on acceptance of 1993 Comprehensive Annual Financial Report (CAFR). Councilmember Schneider moved to accept and place on file the 1993 Comprehensive Annual Financial Report (CAFR), seconded by Councilmember Stehura and passed unanimously. 5. A proposed ordinance de-annexing property between Rockshire Drive and USH 14 was introduced and set for public hearing on August 22, 1994. (File Ordinance No. 94-941) 6. A proposed ordinance rezoning property in the 300 block of South Walnut Street from R3 to Mi was introduced, referred to the Plan Commission and set for public hearing on September 6, 1994. (File Ordinance No. 94-942) 7. A proposed ordinance amending the nonconforming use provision of the zoning ordinance regarding expansion of nonconforming uses was introduced, referred to the Plan Commission and set for public hearing on September 6, 1994. (File Ordinance No. 94-943) 8. A proposed resolution vacating a portion of West Holmes Street between South Pine Street and South Walnut Street was referred to the Plan Commission and set for public hearing on September 19, 1994. (File Resolution No. 94-1818) 9. Matters not on the agenda. In response to Councilmember Heitzman's inquiry regarding grant proposals for a free clinic, the City Manager requested a draft of the request or proposal be forwarded to the Administration.
