06-06-90PROCEEDINGS OF THE CITY COUNCIL CITY OF JANESVILLE SPECIAL MEETING 6 June 1990 Vol. 41 No. 5 Special meeting of the City Council of the City of Janesville, held in the Municipal Building 6 June 1990 at 7:00 p.m. Present: Council President Collins, Councilmembers Pierson, McLean, Schneider, Stehura and Stockwell. Absent: Councilmember Pulliam. 2. Approval of minutes if any. There were no minutes to approve. 3. Non-renewal and revocation/suspension hearing of Class "B" Fermented Malt Beverage and Intoxicating Liquor License issued to Michael Schaffner, sole proprietor d/b/a Blarney Stone, 26 North Academy St. Attached is a complete court transcript of the proceedings. Council decided not to convene into closed session for the purpose of deliberating the non-renewal revocation/suspension of the Class "B" license to Michael Schaffner, sole proprietor d/b/a Blarney Stone - 26 North Academy St. Councilmember Stockwell moved to find the Chief's complaint to be true, seconded by Councilmember McLean. Councilmember McLean then withdrew his second. Councilmember Pierson moved to renew the Class "B" license to Michael Schaffner with the stipulation that the recommendation of the ALAC be followed and that the license be reviewed after 60 and 120 days. The motion was seconded by Council President Collins and failed by the following vote: Aye: Council President Collins, Councilmembers Pierson and Stehura. Nay: Councilmembers McLean, Schneider and Stockwell. Councilmember Stockwell moved to find the Chief's complaint to be true, seconded by Councilmember Schneider and failed by the following vote: Aye: Councilmembers McLean, Schneider and Stockwell. Nay: Council President Collins, Councilmembers Pierson and Stehura. Councilmember Stehura moved to renew the Class "B" license to Michael Schaffner with the stipulation that the recommendation of the ALAC be followed, Michael Schaffner completes a TAM course by 1 August 1990, and that the license be reviewed after 60 and 120 days. The motion was seconded by Councilmember Pierson and failed by the following vote: Aye: Council President Collins, Councilmembers Pierson and Stehura. Nay: Councilmembers McLean, Schneider and Stockwell. Councilmember Stehura moved to grant a Class "B" license to the Blarney Stone, Inc., and then withdrew his motion. Council President Collins moved to renew the Class "B" license to Michael Schaffner with the stipulation that the recommendations of the ALAC be followed, the license be reviewed after 60 and 120 days and the license would be suspended for three days, commencing July 1. The motion was seconded by Councilmember Pierson. Councllmember Stockwell moved to amend the motion by changing the three-day suspension to a 20 day suspension. Motion died for lack of a second. Council then voted on the original motion and it failed by the following vote: Aye: Council President Collins, Councilmembers Pierson and Stehura. Nay, Councilmembers McLean, Schneider and Stockwell. Councilmember Stehura moved to grant a Class "B" license to Michael Schaffner with the stipulation that the recommendations of the ALAC be followed, that the license be reviewed after 60 and 120 days, and that Michael Schaffner voluntarily surrender his current license commencing June 8, 1990 for five days. Motion seconded by Council President Collins and failed by the following vote: Aye: Council President Collins, Councilmembers Pierson and Stehura. Nay: Councilmembers McLean, Schneider and Stockwell. Councilmember Pierson moved to adjourn. Motion failed by the following vote: Aye: Councilmembers Pierson and McLean. Nay: Council President Collins, Councilmembers Schneider, Stehura and Stockwell. Councilmember Schneider moved to renew a Class "B" license to Michael Schaffner with the provisions that the recommendations of the ALAC be followed, that the license be reviewed after 60 and 120 days, and that the Council suspend the license for ten days commencing June 8th. Motion seconded by Council President Collins and failed by the following vote: Aye: Council President Collins, Councilmembers Pierson and Schneider. Nay: Councilmembers McLean, Stehura, and Stockwell. Councilmember Pierson moved to renew a Class "B" license to Michael Schaffner with the stipulation that the recommendations of the ALAC be followed, that the license be reviewed after 60 days, and the ALAC submit a definite recommendation after 120 days to Council and that Michael Schaffner complete the TAM course. Motion seconded by Councilmember Stehura and failed by the following vote: Aye: Council President Collins, Councilmembers Pierson and Stehura. Nay: Councilmembers McLean, Schneider and Stockwell. Councilmember McLean moved to not renew the Class "B" license to Michael Schaffner and the motion died for lack of a second. Councilmember Stehura moved to renew a Class "B" license to Michael Schaffner with the provisions that the recommendations of the ALAC be followed, that the license be reviewed after 60 and 120 days, that Council suspend the license for seven days, commencing June 8th, 1990 and Michael Schaffner complete the TAM course by August l, 1990. The motion was seconded by Councilmember Schneider and passed by the following vote: Aye: Council President Collins, Councilmembers Pierson, Schneider and Stehura. Nay: Councilmembers McLean and Stockwell. Prior to the vote, Mr. Schaffner indicated that he would stipulate to the suspension. There being no further business, the meeting was adjourned at 11:25 p.m. These minutes are not official until approved by the City Council. Jean Ann Wulf City Clerk
