2026-2438RESOLUTION NO. 2026 – 2438
A Resolution Repealing the Proclamation of Emergency.
WHEREAS, because of major flash flooding events which damaged real property,
buildings, vehicles, and closed major streets and thoroughfares, and threatened the
public health, welfare, safety, peace, and good order in the City of Janesville on Friday
evening, the 17th day of April 2026, City Manager Kevin M. Lahner issued a certain
Proclamation of Emergency; and
WHEREAS, the Proclamation of Emergency was issued pursuant to Wisconsin Statute
Sections 323.11, 323.14, Chapter 323, Wis. Stats., Janesville General Ordinance
Sections 2-410 to 2-415, and all other applicable and/or pertinent provisions of federal,
state, and/or local law; and
WHEREAS, pursuant to Wisconsin Statute Section. 323.14(4)(b)2., the Proclamation was
and is subject to ratification, alteration, modification, or repeal by the governing body of
the City of Janesville as soon as that body can meet, but the subsequent actions taken
by the governing body shall not affect the prior validity of the Proclamation or the actions
taken or directed by the City Manager; and
WHEREAS, the Common Council ratified, affirmed, and made City Manager Kevin M.
Lahner’s Proclamation of Emergency its own at their regularly scheduled meeting on
Monday, April 27, 2026; and
WHEREAS, the emergency no longer exists and the City Manager’s Proclamation of
Emergency as ratified by the Common Council may be repealed by the Common Council
at this time;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY
OF JANESVILLE AS FOLLOWS:
1.Each of the above recitals is reiterated and incorporated herein as if fully set forth
verbatim; and
2.The Common Council hereby find that the emergency no longer exists; and
3.The Proclamation of Emergency issued by City Manager Kevin M. Lahner on
Friday evening, the 17th day of April 2026, and ratified and affirmed by the Common
Council on Monday, the 27th day of April 2026, is no longer necessary and is hereby
repealed; and
4.All of City Manager Kevin M. Lahner’s previous actions, decisions, orders, and
directions, and those of his designees, are hereby ratified, affirmed, and valid.
