A RESOLUTION AUTHORIZING THE EXECUTION OF A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF JANESVILLE AND DK PARTNERSHIP, LLP, TO EXTEND PUBLIC INFRASTRUCTURE AT MCCORMICK DRIVE AND HUNTINGHORNE DRIVE
WHEREAS, the City of Janesville has identified McCormick Crossing as one of the City’s significant housing development opportunities, consistent with the City’s Strategic Plan priority of promoting economic development and housing; and
WHEREAS, DK Partnership, LLP has proposed to construct public infrastructure to support multi-family residential development as part of McCormick Crossings; and WHEREAS, the geometry and access requirements that stem from Traffic Impact
Analysis will necessitate public improvement construction of a single-lane roundabout at the intersection of McCormick Drive and Huntinghorne Drive; and WHEREAS, City staff and DK Partnership, LLP have negotiated a Memorandum of Understanding outlining the respective responsibilities of each party regarding
construction, maintenance, and cost sharing; and
WHEREAS, the location and design of the proposed infrastructure are consistent with the City’s Comprehensive Plan and land use regulations; and
WHEREAS, as part of the agreement, the City will reimburse DK Partnership, LLP the
costs associated above a standard four-way intersection, in an amount not to exceed Five Hundred Forty Five Thousand and 00/100 Dollars ($545,000.00), and upon the terms and conditions set forth in the agreement; and
WHEREAS, the City Council finds that entering into the Memorandum of Understanding
promotes public health, safety, and welfare by strengthening Janesville’s public infrastructure and fostering housing development at McCormick Crossing; NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of
Janesville, Rock County, Wisconsin, that:
1. Each of the above recitals is reiterated and incorporated herein as if fully set forth verbatim; and 2. A copy of the proposed Memorandum of Understanding is attached hereto and
incorporated herein verbatim as Exhibit A; and
3. The proposed Memorandum of Understanding between the City of Janesville and DK Partnership, LLP, is hereby approved.

BE IT FURTHER RESOLVED that the City Manager and his designee(s) is/are authorized to execute and enter into said Memorandum of Understanding on behalf of the City of Janesville, and to take such actions and make such amendments thereto, from time to time and at any time, as he may determine necessary and/or desirable on behalf
of the City of Janesville to effectuate the intent of this Resolution and/or the best interests of the City.
