A Resolution Ratifying the City Manager’s Proclamation of Emergency.
WHEREAS, because of major flash flooding events which damaged real property,
buildings, vehicles, and closed major streets and thoroughfares, and threatened the
public health, welfare, safety, peace, and good order in the City of Janesville on Friday
evening, the 17th day of April 2026, City Manager Kevin M. Lahner issued a certain
Proclamation of Emergency; and
WHEREAS, the Proclamation of Emergency was issued pursuant to Wisconsin Statute
Sections 323.11, 323.14, Chapter 323, Wis. Stats., Janesville General Ordinance
Sections 2-410 to 2-415, and all other applicable and/or pertinent provisions of federal,
state, and/or local law; and
WHEREAS, pursuant to Wisconsin Statute Section. 323.14(4)(b)2., the Proclamation was
and is subject to ratification, alteration, modification, or repeal by the governing body of
the City of Janesville as soon as that body can meet, but the subsequent actions taken
by the governing body shall not affect the prior validity of the Proclamation or the actions,
decisions, or orders taken or directed by the City Manager; and
WHEREAS, that emergency continues to exist with additional potential flooding of
properties, streets, roadways, and related damage to public and private properties
foreseen; and City employee and City contractor clean-up efforts from, and expenditure
of City resources and finances pertaining to, the April 17, 2026, flood damage continues
and will continue into the foreseeable near future; and
WHEREAS, the ratification of the City Manager’s Proclamation of Emergency will render
it in full force and effect, and make it the Common Council’s Proclamation of Emergency
for all intents and purposes, until such time as the emergency in the City no longer exists
and the City Manager’s ratified Proclamation of Emergency is repealed by the Common
Council.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY
OF JANESVILLE AS FOLLOWS:
1.Each of the above recitals is reiterated and incorporated herein as if fully set forth
verbatim; and
2.The Common Council hereby find that the emergency continues to exist, and
potential flood and related emergencies continue to exist; and
3.The Proclamation of Emergency issued by City Manager Kevin M. Lahner on
Friday evening, the 17th day of April 2026, is hereby ratified and affirmed, and shall
remain in full force and effect, as if it were the Common Council’s own
Proclamation of Emergency, until repealed by the Common Council in the future.
4.All of City Manager Kevin M. Lahner’s previous actions, decisions, orders, and
directions are hereby ratified, affirmed, and valid; and
5.City Manager Kevin M. Lahner and his designee(s) is/are hereby fully empowered
and authorized to take such additional actions and make such addition decisions,
orders, and directions as he and/or they may determine necessary and/or
desirable under the ratified Proclamation of Emergency.
