RESOLUTION NO. 2026-2427
A resolution conveying a utility easement to Alliant Energy on City-owned
property at 100 Momentum Drive for purposes of installing an above-ground
natural gas regulator station.
WHEREAS, Alliant Energy has requested that the City of Janesville convey a utility
easement on City land located at 100 Momentum Drive in the City of Janesville, County
of Rock, State of Wisconsin, for purposes of installing, maintaining, and operating an
above-ground natural gas regulator station; and
WHEREAS, the Common Council of the City of Janesville supports Alliant’s investment
into their facilities across the community; and
WHEREAS, Alliant Energy has agreed to compensate the City $5.28 per square foot for
the easement area, which encompasses 25 feet by 25 feet for a total area of 625
square feet. This equates to a total compensation of $3,300.00 to be deposited into the
Parkland Acquisition Fund; and
WHEREAS, Alliant Energy will obtain a right-of-way permit from the City of Janesville
for this work which outlines restoration conditions associated with all work located in the
public right-of-way and within the defined easement; and
WHEREAS, at its sole cost, Alliant Energy will maintain, repair, replace, and enhance
the above-ground gas regulator station; at all times maintain the easement and
improvement(s) thereon in good working order, and in clean and sightly condition; and
remove and restore the easement site back to its original good condition when the
easement area is no longer used by Alliant for an above-ground natural gas regulator
station; and
WHEREAS, the Plan Commission reviewed this easement and proposed land use at
their meeting on the 6th day of April, 2026, finding it appropriate and consistent with City
plans, but not commenting on the financial aspects; and
WHEREAS, the Common Council hereby find that this easement benefits Alliant
Energy, which is a valued member of our community; and also promotes the public
interest;
NOW, THEREFORE, IT IS HEREBY RESOLVED, by the Common Council of the City
of Janesville that:
1. Each of the above introductions and recitals are incorporated herein by reference
as if fully set forth verbatim; and
2
2. The City Administration is authorized, on behalf of the City of Janesville, to
negotiate and execute a utility easement with Alliant Energy as described in the
attached document and as set forth above; and
3. The City of Janesville will not be charged, or pay, for any costs arising from
and/or related to this easement, the gas regulator station, or the actual work
performed related to this easement; and
BE IT FURTHER RESOLVED, that the City Manager and his designee(s), on behalf of
the City of Janesville, is/are hereby jointly and severally authorized and empowered to
negotiate, draft, review, revise, modify, amend, execute, enter into, file and/or record
additional amendments and documents concerning this matter, and to take whatever
additional other actions that the City Manager may determine, in his sole discretion,
from time to time and at any time, necessary and/or desirable in the public interest to
effectuate the intent of this Resolution.
