A Resolution extending the public works special assessment(s) deferment
for a property located at 2222 Summit Drive.
Whereas, on October 9, 2006, the City Council approved final Resolution No. 2006-342
which levied special assessments against multiple properties in a new development,
including, but not limited to, 2222 Summit Drive in the City of Janesville, County of
Rock, State of Wisconsin 53548 for certain public works; and
Whereas, these special assessments were “deferred without interest accruing thereon,
until such time as their specific property is annexed or connects to City sewer and
water, in which event the special assessment shall be due and payable either in full or
in or in five (5) annual installment payments, the latter with interest accruing thereon
from the date of the annexation or connection” to City water and/or sewer. The
Resolution showed the interest rate at that time to be 7.25%; and
Whereas, on or about April 14, 2014, this parcel located at 2222 Summit Drive
connected to City sewer and water which was the condition precedent to the property
owner paying the $13,113.50 deferred special assessment to the City; and
Whereas, the property changed hands from the preceding to the current owners Jean
Baker and/or Chris Armstrong who have now requested a renewed and/or continued
deferment without interest of this special assessment which was not paid in 2014; and
Whereas, the Common Council feels it is appropriate under these particular facts and
circumstances to renew and continue the payment deferment of the special assessment
principal.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY
OF JANESVILLE THAT:
1.Each of the above recitals is reiterated and incorporated herein by reference as if
fully set forth verbatim; and
2.The previously levied deferred special assessment shall continue deferred until the
property is sold or otherwise conveyed or alienated in any manner; and
3.There shall be no interest thereon accruing; and
4.All other original terms and conditions in the original levy resolution not specifically
modified herein shall remain in full force and effect.
