Absent: Councilman Griffith. Councilman Smith made a motion to approve the minutes of the special meeting of June .--7-,_1971-.as...distributed.- Motion -seconded -by -Councilman Rude -and adopted unanimously. License Applications The City Manager presented Mr. Softee's license application for further Council ---consideration. Attorney Jim Thorpe, representing Mr. Reimer, requested the Council to defer action on this item to the next city council meeting. Councilman Roth made a motion to set this matter of business over until the next meeting. Motion seconded by Councilman Karleski __ and _adopted unanimously. A list of license application renewals for the coming year was presented. Councilman Roth.made a motion that all licenses be granted as listed. Motion seconded by Councilman Rude and adopted unanimously. (All applications of licenses are on file in the Office of the City -Clerk and are incorporated by reference herein and may be examined upon request at all reason- able times) . . .Ord i nnneP. -As requested by the Council, the City Manager submitted five proposed ordinances regarding permitting dispensing of fermented malt beverage and food within the city park system. -Councilman Roth made a motion --to poll -the -Council to get a concensus of the Council on this proposed matter of business. The motion died -for lack of a second. Council President Lovejoy asked for a motion expressing the Council's feelings on -granting a permit to dispense beer in the parks. Councilman Rude suggested taking the items --one-at a time. 1. A proposed ordinance creating exceptions to prohibition against f-ermented malt beverage sale and consumption in parks was presented. Councilman Smith made a motion that the ordinance be tabled. Motion seconded by Councilman Roth and -- ---------adopted -by -the fol-lowing- vote— Aye: -Councilmen- Smith-, _-Hall '-Lbvdj 6y and Roth; Nay: Councilmen Rude and Karleski; Absent: Councilman Griffith. (File Ordinance _ No._71-227) proposed ordinance repealing certain -food regulation requirements was presented. Councilman Rude asked the City Attorney to read the ordinances proposed.to be repealed. City Manager Bailey stated that he had contacted the_City_Sanitarian '� Clifford Wanke, and he had informed the Manager that Sections 7.07 (2) (3) (4) cannot be repealed because they are part of the Wisconsin Administrative Code. The City Manager informed the Council that we could avail ourselves of another part of the Wisconsin Administrative Code which arranges for a temporary permit. Councilman Smith made a motion that Ordinance No. 71-225 be tabled and let Section H96_of the State Administrative Code be adopted by reference. Motion seconded by Councilman Karleski. Councilman Roth suggested that the ordinance be amended and not tabled. Councilman Smith amended his motion to delete Sections 7.07 (2) (3) and (4) and adopt Section H96 of the State Administrative Code by reference. Motion seconded by Councilman Karleski and adopted by the following vote: Aye: Councilmen Rude, Smith, Karleski, Hall and Lovejoy; Nay: Councilman Roth, Absent: Councilman Griffith. The City Attorney was directed to amend the ordinance for consideration later in the meeting. Council President Lovejoy read the amended ordinance. Councilman Roth introduced the ordinance and requested the second reading by title only. Councilman Roth made a motion to suspend the rules. Motion seconded by Councilman Smith and adopted unanimously. The proposed ordinance was given its third reading and public hearing. Appearing before the Council were Mark Korb and Ted Wright. Councilman Roth made a motion to adopt the amended ordinance. Motion seconded by Councilman Rude and adopted unanimously. (File Ordinance No. 71-225) 3. A proposed ordinance repealing prohibition of use of parks or public property for purpose of financial return was presented. The City Manager suggested amending the ordinance with an exception by special permit of the City Council. Council President Lovejoy suggested deleting the second sentence and adding the exception suggested by the City Manager. The City Attorney was directed to redraft the ordinance for consideration later in the meeting. The proposed amended ordinance amending prohibition of use of parks or public pro- perty for purpose of financial return was introduced by Councilman Rude and given its first and second reading. Councilman Roth made a motion to suspend the rules. Motion seconded by Councilman Rude and adopted unanimously. The proposed ordinance was given its third reading and public hearing. Councilman Roth made a motion to adopt said amended ordinance. Motion seconded by Councilman Rude and -'adopted unanimously. (File Ordinance No. 71-226) Councilman Rude made a motion to grant the Jaycees a permit to sell bratwurst during their 4th of July Celebration under the revised ordinances. Motion seconded by Councilman Smith and adopted unanimously. Councilman Roth made a motion that the food license fee be waived. Motion seconded by Councilman Karleski.and adopted unanimously. 4.*- An•amended proposed ordinance establishing an exception to the food and drink - li.cense was introduced by Councilman Rude and given its first and second reading. A'public hearing was scheduled for June 28, 1971 at 7:30 P.M. (File Ordinance No. 71-228) 5. A proposed ordinance creating an exception to the food and drink ordinance was not introduced and no action taken. (File Ordinance No. 71-229) Resolutions Reports 1. The statement supporting Senate Bill No. 138 was re -presented. Councilman Smith made a motion to table this statement and offered a substitute resolution which he read. Motion seconded by Councilman Roth. The City Attorney stated they should vote on the tabling action first. Councilman Smith amended his motion to table this statement. Motion seconded by Councilman Roth and adopted by the following vote: Aye: Councilmen Rude, Smith, Karleski; Roth and Lovejoy; Nay: Councilman Hall; Absent: Councilman Griffith. Councilman Smith made a motion to adopt his previously read,resolution. Motion seconded by Councilman Karleski and adopted by the following vote: Aye: Council- men Rude, Smith, Karleski, Roth, and Lovejoy; Nay: Councilman Hall; Absent: Councilman Griffith. (File Resolution No. 71-209.) 2. Councilman Hall stated that Sunday, June 20, 1971, is the dedication day for the Walter Reuther Memorial Building and would like to offer a resolution of commen- dation on said event. Councilman Hall made a motion that an appropriate resolu- tion be prepared by the City Attorney and that the proposed resolution be adopted at this meeting. Motion seconded by Councilman Roth and adopted unanimously. (File Resolution No. 71-211) 1. Council President Lovejoy presented a tabulation of low bids received June 11, 1971 with the recommendation from the Committee of Public Works that the following con- tracts be awarded: a) Sanitary Sewer, Water Mains and Materials Co., Inc. b) Curb and Gutter - F. P. & T. and Laterals - Madden Constructing ` $ 101,150.00 Construction Co. 63,130.00 - 2 - SEAL c) Bituminous Paving - Rock Road Construction Company $145,650.00 and the following low bid be rejected because of the extreme high cost d) Roof revisions at #2 Water Pumping Station - Meyer Construction Corporation $ 7,900.00 Councilman Karleski made a motion to approve the recommendation of the Committee of Public Works. Motion seconded by Councilman Roth and adopted unanimously. 2. The financial statement for May was presented. Councilman Hall moved the financial statement be accepted and placed on file for audit. Motion seconded by Councilman Roth and adopted unanimously. 3. The City Manager submitted a report on an experimental Air Curtain Destructor. The City Manager recommended Council authorization for the Ckty Manager to enter into an agreement with Wolfgang A. Kutrieb Company for the use of city land to construct an experimental Air Curtain Destructor with no cost to the city, the city to be held harmless from any damage to persons or property arising from the operation of the Air Curtain Destructor and providing the agreement be in accordance with all federal,•state and local laws and regulations. Mr. Kutrieb explained the operation to the Council and quoted comparable incinerator cost to be $500,000.00 as against a maxirwam cost of $8,000.00 for the Air Curtain Destructor. Councilman Roth made a motion to authorize the City Manager to enter into an. agreement as stated. Motion seconded by Councilman Rude and adopted unanimously.
