No. 81-238) -4- PROCEEDINGS OF THE CITY COUNCIL CITY OF JANESVILLE, WISCONSIN REGULAR MEETING 15 June, 1981 Vol. 33 No. 69 Regular meeting of the City Council of the City of Janesville, held in the Municipal Building 15 June, 1981 at 7:30 p.m. Present: Council President Stabb, Councilmembers Stehura, Miles, Wexler, Bolton and Schroder. Absent: Councilmember Fink. The minutes of the regular meeting of 1 June, 1981 were presented. Councilmember Miles made a motion to approve the minutes of the regular meeting of 1 June, 1981 as distributed. Motion seconded by Councilmember Bolton and adopted unanimously. The minutes of the special meeting of 9 June, 1981 were presented. Councilmember Bolton made a motion to approve the minutes of the special meeting of 9 June, 1981 as distributed. Motion seconded by Councilmember Miles and adopted unanimously. LICENSES: Councilmember Miles made a motion that the following license applications be approved and issued: Operators (Bartenders) - Renewal as listed. Electricians - Renewal as listed Amusement Devices/Operators, Centers & Machines - Renewal as listed Trailer/Mobile Home Park - Renewal as listed Waste Collector and/or Hauler - Renewal as listed Motion seconded by Councilmember Bolton and adopted unanimously. Councilmember Wexler requested that an ordinance be prepared to repeal that portion of the ordinance dealing with milk and cream dealers since most of the control in this area is done by the state. No further action was taken on the milk and cream dealer renewal. Councilmember Miles made a motion that the following license applications be approved and issued for a special event one day Class "B" BE�er Only License for: St. Mary's Congragation - 313 East Wall Street, Cal McCarthy, Agent (Event to be held August 16, 1981 ) Janesville Jaycees, Inc. - Richard A. Austin, Agent (Event to be held July 4th at Traxler Park ) and that fees be waived. Motion seconded by Councilmember Bolton and adopted unanimously. Councilmember Wexler made a motion that the following license applications be approved and issued for: Mid States Management, Inc. (Left Guard) - 3920 Milton Ave., Terry McGuire, Agent. Council President Stabb questioned when the sale or transfer of agent took place? Mr. Robert Clem of 804 Suffolk Drive stated that he was an employee of the establishment and the business changed hands about November 13, 1980. It was brought out during the ensuing discussion that no one was aware of such sale or transfer. Motion seconded by Councilmember Miles and adopted unanimously. Council President Stabb informed the Council that the application for Class "B" Intoxicating Liquor and Fermented Malt Beverage license renewal for the Milton Avenue.Pub, Inc. of 1819 Milton Avenue be held over for two weeks to clear up the matter as to who is the holder of the Wisconsin Sellers Permit (All applications of licenses are on file in the Office of the City Clerk and are incorporated by reference herein and may be examined upon request at all times.) REQUESTS AND COMMENTS FROM THE PUBLIC ON MATTERS NOT ON THE AGENDA: Mr. Duane Mallard of 314 North High Street and Mr. Pat McGuire of 1020 North Marion Avenue both appeared before the Council to request zoning changes. Mr. Duane Mallard for the property surrounding the area around Accudyne Corp., while Mr. McGuire referred to the Blackhawk Credit Union on South Academy Street. ORDINANCES: 1. A proposed ordinance repealing the entire chapter presently dealing with "Zoning and Planning" and creating a new chapter to replace the current zoning ordinance was continued from the previous meeting. City Manager Deaton gave a brief review and presented the recommendation of the Planning Commission that had been referred back to it. Council President Stabb stated that they would have to act on the recommendation of the Plan Commission before they could act on the motion to adopt the ordinance that had been made two weeks before. Councilmember Wexler made a motion to change the zoning of the two roofing companies to M-2 as recommended by the Plan Commission. Motion seconded by Councilmember Bolton and adopted by the following vote: Aye: Council President Stabb, Councilmembers Stehura, Wexler, Bolton and Schroder. Nay: Councilmember Miles. Council President Stabb stated that the long awaited time to vote on this matter is now at hand. Councilmember Wexler made a motion (1 June, 1981 which was held over by Council President Stabb until 15 June, 1981 to vote on it) that Ordinance No. 80-208 be adopted as amended. Motion seconded by Councilmember Miles and adopted unanimously. Councilmember Stehura made a motion that the fees be waived for those individuals that appear before the Plan Commission for 60 days from the date of publication. Motion seconded by Councilmember Miles and adopted unanimously. (File Ordinance No. 80-208) 2. Propsed ordinances (No. 81-237) amending the category of persons to whom intoxicating liquor may be sold by a club or lodge and (No. 81-238) increasing the fee charged clubs and lodges for an intoxicating liquor license from $300 to $500 were given their second reading by title only and public hearing. Appearing before the Council to be heard were Donald J. Stone of 1505 East Memorial Drive, against Ordinance No. 81-238. Donald Doering of 2126 Mt. Vernon Avenue stated he opposed Ordinance No. 81-238 and that Mr. Fink has misused his power as a Councilmember. Walt Albright, 220 North Oakhill Avenue, against Ordinance No. 81-238. Councilmember-Bolton made a motion to adopt said Ordinance 81-237 as presented. Motion seconded by Councilmember Stehura and adopted -by -the following vote:_ Ave: Councilmembers Stehura.-Miles, Wexler, Bolton and Schroder. Nav: Council President Stabb. (File Ordinance No. 81-237) After voting on Ordinance No. 81-237, the discussion continued on Ordinance No. 81-238. Councilmember Schroder stated that he supported Mr. Fink's position on Ordinance No. 81-238 and that he would make a motion to adopt said ordinance as presented. Motion seconded by Council President Stabb and is not adopted because of the following tie vote: Aye: Council President Stabb, Councilmembers Wexler and Schroder. Nay: Councilmembers Stehura, Miles and Bolton. (File Ordinance No. 81-238) RESOLUTIONS: 1. A proposed resolution on the 1981 Capital Improvement Bond issue was presented by City Manager Deaton for the total amount of $9,400,000 broken down into three priority lists. Priority No. 1 for $6,521,000.00 Priority No. 2 for 2,493,000.00 Priority No. 3 for 386,000.00 After City Manager Deaton's presentation, Council President Stabb presented each item which was discussed by the Councilmembers in detail amongst themselves and with the administration. Mr. Daniel Bradbury reviewed the request for the Public Library. Mr. Ralph Parker presented the review for the golf course. -2- Mr. Terry Campbell, Bumper Hostetler and Bill Walter presented the request to bring back Minor League Baseball to Janesville. Councilmember Wexler made a motion to delete Priority List item No. 3, (Fire Department - pumper truck $140,000.00 ) (Paramedic Chassis 21,000.00 i (Fire Department - training area 150,000.00 } (Fire Department - truck revolving fund 75,000.00 } ( 386,000.00 } in the amount of $386,000.00 and to introduce Resolution 81-457. Motion seconded by Councilmember Miles and adopted unanimously. (File Resolution No. 81-457) 2. A proposed resolution amending the amount of Industrial Revenue Bond from $450,000.00 to $500,000.00 for the Lenair Industries (Leslie D. Marzahl and Nancy L. Marzahl) W&s presented. Councilmember Miles made a motion to adopt said resolution as presented. Motion seconded by Councilmember Wexler and adopted unanimously. (File Resolution No. 81-458) MISCELLANEOUS: 1. City Manager Deaton presented the recommendation of the Committee of Public Works for the Pumping Station No. 8 contract bids to the following: General Construction - Gilbank Construction $ 63,620.00 Mechanical - Mechanical systems 73,800.00 Electrical - Westphal & Co. 30,400.00 TOTAL . . . . . . . . $167,820.00 Councilmember Schroder made a motion to award the contracts as recommended by the Committee of Public Works. Motion seconded by Councilmember Stehura and adopted unanimously. 2..,-City Manager Deaton gave a brief review of the past sidewalk policy and Council attitude as well as the prior Citizen Committee to draft a policy statement that was rejected by the Council. After a brief discussion, which each Councilmember stated their view, Councilmember Stehura made a motion that a task force committee be created for the purpose of creating a sidewalk policy. Motion seconded by Councilmember Schroder and adopted by the following vote: Aye: Council President Stabb, Councilmembers Stehura, Bolton and Schroder. Nay: Council - members Miles and Wexler. Council President Stabb presented the following names to be considered for the sidewalk task force: Councilmember Richard Schroder, Chairperson Councilmember Thomas Stehura Mr. Arthur. Johnson - 940 Hawthorne Mrs. Faye Anderews - 2804 Dartmouth Mrs. Theodore Albrecht - 133 South Harmony Drive Councilmember Bolton made a motion to approve the names of the sidewalk task force as submitted. Motion seconded by Council President Stabb and adopted unanimously. MATTERS NOT ON THE AGENDA: 1. Councilmember Miles requested that the city administration review the first entrance into the Memorial Plaza off of Memorial Drive for safety purposes. 2. Councilmember Bolton made a motion to convene in closed session for the purpose of dealing with the matter of property acquisition, Wisconsin Statute Section 19.85 (1)(e) and (g). Motion seconded by Councilmember Miles and adopted unanimously. The Council then convened into closed session at 10:35 p.m. These minutes are not official until approved by the City Council.
