Regular meeting of the City Council of the City of Janesville,
held in the Municipal Building 21 September 1989 at 7:30 p.m.
The meeting was called to order by Council President Stockwell.
PRESENT: Council President Stockwell, Councilmembers Pierson,
Pulliam, Stehura, McLean, and Schneider. Councilmember Collins
arrived at 7:32 p.m.
CONSENT AGENDA
Minutes of the regular meeting held 5 September 1989.
Minutes of the study session held 21 August 1989.
Licenses; and recommendations of the Alcohol License Advisory
Committee.
Financial gain requests: A) Action on a request from St. Mary's
Home and School Association for permission to hold their annual
Steeple Chase at Riverside Park on Sunday, 8 October 1989, and B)
Action on a request from Janesville Area Teachers Association
for permission to use the Senior Center for their annual public
card party on Saturday, 2 December 1989.
Council President Stockwell stated that if there were no
objections, the Consent Agenda would be approved, except for
minutes of the study session held 21 August, and action on
licenses, which would be taken separately. He asked that the
minutes show that Councilmember McLean passed on the vote for
approval of the August 21 study session.
Councilmember Stehura moved that the licenses, as listed on the
license agenda and on file in the office of the City Clerk, be
approved and issued as presented, except for Donald Klossner.
Motion seconded by Councilmember Pierson and passed unanimously.
Mr. Klossner told the Council that he needed his bartender
license for a second job for supplemental income. Councilmember
Collins told him that he could work as a bartender under the
supervision of a licensed bartender without a license.
Councilmember Stehura moved to grant Mr. Klossner a license,
seconded by Councilmember Collins and failed by the following
vote: Aye: Councilmember Stehura. Nay: Council President
Stockwell, Councilmembers Pierson, Collins, Pulliam, McLean and
Schneider.
(All applications of licenses are on file in the office of the

City Clerk and are incorporated by reference herein and may be
examined upon request at all reasonable times.)
OLD BUSINESS
1. Requests and comments from the public on matters which can be
affected by Council action. Fire Chief Art Stearns introduced
Mr. and Mrs. Terry Sheridan, and told how they had worked for the
past five years on a book about the history of the City and the
fire department. They presented Council President Stockwell with
a copy of their book.
Mr. Donald Bontje of 1239 Bingham requested a stop -and -go light
for the intersection at Beloit Avenue and State Street. This
matter was referred to the administration by Council President
Stockwell.
Mr. Wayne Caswell of 1002 Bouchard Av. explained why he felt that
the "NO TURN ON RED" sign at the corner of Racine and Main
Streets was in the wrong place. He stated that some kind of
traffic control was necessary at the intersection of Palmer Park
Drive and Racine Street.
2. A proposed revised ordinance, recommended for approval by the
Plan Commission, rezoning property located at 851 Kellogg Avenue
from R3 and R1 to 01 was reviewed by Acting City Planning
Director Brad Cantrell and given its second reading by title only
and public hearing. No one appeared for the public hearing.
Councilmember Pierson stated he would have to pass on this
matter. Councilmember McLean moved to adopt said Revised
Ordinance 89-642 as presented, seconded by Councilmember Pulliam
and adopted by the following vote: Aye: Council President
Stockwell, Councilmembers Collins, Pulliam, Stehura, McLean and
Schneider. Pass: Councilmember Pierson. (File Revised

3. A proposed ordinance amending the Parkland Acquisition Fund
Subdivision Ordinance was given its second reading by title only
and public hearing. Mr. Wayne Caswell of 1002 Bouchard Av. asked
if he could see a copy of the ordinance. Council President
Stockwell postponed the matter for two weeks (2 October 1989) to
continue the public hearing. No further action was taken. (File

4. A proposed ordinance increasing the speed limit from 25 MPH
to 35 MPH on East Delavan Drive, between Beloit Av. and the City
limits, was reviewed by City Manager Sheiffer. He asked
that the public hearing be opened and continued until 2 October
19891 so the County could act on this matter. The ordinance was
given its second reading and the public hearing opened and then
continued until 2 October 1989. (File Ordinance No. 89-645)
5 & 6. Council President Stockwell postponed these two items -
Action and public hearing of a proposed resolution vacating
portions of North River St., Ravine St., and Mineral Point Av.;
and, Second reading and public hearing of a proposed ordinance
rezoning property located east of North Franklin St. between
Mineral Point Av. and Centerway (Res. 89-1201 and Ord. 89-641
respectively) until 2 October 1989.
NEW BUSINESS
1. A proposed resolution authorizing the filing of an
application with the State Demographic Services Center for a
Public Information Grant for the 1990 Census. Councilmember
Pulliam moved to adopt said resolution as presented, seconded by
Councilmember McLean and adopted unanimously. (File Resolution
No. 89-1211)
2. A proposed ordinance prohibiting rent absconding was
introduced by Council President Stockwell and given its first
reading by title only and set for public hearing 2 October 1989
at 7:30 p.m. This was followed by a brief discussion with
Councilmember Pierson moving not to introduce this ordinance,
seconded by Councilmember McLean and failed by the following
vote: Aye: Council President Stockwell, Councilmembers Pierson
and McLean. Nay: Councilmembers Collins, Pulliam, Stehura and
Schneider. Council President Stockwell stated that the public
hearing scheduled for 2 October 1989 would stand. (File

3. A proposed ordinance rezoning property located on Ba-Wood
Lane from R1 to R3 was introduced by Council President Stockwell
and given its first reading by title only and referred to the
Plan Commission for a report and recommendation. A public hearing
was set for 16 October 1989 at 7:30 p.m. (File Ordinance No. 89-
649)
4. A proposed resolution vacating North River St. between
Mineral Point Av. and the railroad right-of-way, and portions of
Ravine Street and Mineral Point Av. was introduced by Council
President Stockwell and referred to the Plan Commission for a
report and recommendation. A public hearing was set for 30
October 1989 at 7:30 p.m. (File Resolution No. 89-1210)
5. , A proposed resolution vacating North River Street between
Mineral Point Av. and Ravine Street, and portions of Ravine
Street and Mineral Point Av. was introduced by Council President
Stockwell and referred to the Plan Commission for a report and
recommendation. A public hearing was set for 30 October 1989 at
7:30 p.m. (File Resolution No. 89-1212)
6. Matters not on the Agenda. City Manager Sheiffer stated that
there was a need to hold an MPO Policy Board meeting at 7:00 p.m.
on 2 October 1989, if there were no objections from the Council.
There were no objections.
7. Councilmember Stehura moved to convene into closed session
pursuant to Section 19.85 (1)(g), Wis. Stats., for the purpose of
conferring with legal counsel for the governmental body who is
rendering oral and/or written advice concerning strategy to be
adopted by the body with respect to a claim which may likely
result in litigation; and Section 19.85 (1)(e), Wis. Stats. for
the purpose of deliberating or negotiating the potential purchase
and/or sale of public property. Motion seconded by Councilmember
McLean and adopted unanimously.
There being no further business, the meeting was adjourned at
8:20 p.m. to reconvene in closed session.
