An ordinance amending various alcohol and alcohol license ordinances, with penalties for violations thereof as
set forth in Janesville General Ordinance Section 6-104.
THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS:
SECTION I. Section 6-21(e) of the Code of General Ordinances of the City of Janesville is hereby amended
to read as follows:
“(e) Also exempt from the prohibitions of this and related ordinances are : (1) for permits granted by the
Recreation Director and/or his or her their designee in accordance with JGO 26-13 allowing the
possession and consumption of fermented malt beverages and wines in the designated areas of Traxler
Park, Riverside Park, Palmer Park, the Town Square, Water Street, and Festival Street (River Street
from Milwaukee Street to Court Street) and all abutting public property when Festival Street is rented
for a private event; and (2) those events exempted under JGO Secs. 6-26.
SECTION II. Section 6-26 of the Code of General Ordinances of the City of Janesville is hereby amended to
read as follows:
“Sec. 6-26. - Possession, sale and consumption of fermented malt beverages, wines, and
intoxicating liquors permitted at specific public parks, city facilities, and other public property.
(a)For purposes of this section, the following terms shall be defined as follows:
Beer, fermented malt beverages and fermented malt beverage based wine coolers mean those
alcohol beverages as defined in Wis. Stats. c h. 125, as from time to time amended, and/or as defined
and/or interpreted by the Wisconsin Department of Revenue, as from time to time modified.
City means the City of Janesville and its lawfully authorized officials, officers, employees, agents ,
authorized and/or permitted license holders , and representatives.
Lessee means the person managing, leasing , holding a valid alcohol license for, and/or operating the
City of Janesville owned public golf course , park, Woodman’s Sports and Convention Center, other
City facility, or other public facility, under a written lease or other instrument or agreement with the
City of Janesville, and the lessee's lawfully authorized licensee, officials, officers, employees, and/or
agents.
Wine and Intoxicating liquors mean those alcohol beverages as defined in Wis. Stats. ch. 125, as
from time to time amended, and/or as defined and/or interpreted by the Wisconsin Department of
Revenue. For purposes of this and related ordinances and documents, “intoxicating liquor” includes
“wines”.
(b)Anything contrary to elsewhere in the Code of General Ordinances of the City of Janesville
notwithstanding, the possession, sale , and consumption of fermented malt beverages and
intoxicating liquors (including, but not limited to wines ) are permitted at the following public parks,
City facilities, public facilities, or other public property, but only in strict accord with the provisions of
this chapter:
(1)Riverside Golf Course.
(2)Blackhawk Golf Course.
(3)Rotary Gardens.
(4)Dawson Park and Field.
(5)The Tallman House, Hellen Jeffris Wood Museum and Visitor Center.
(6)Woodman’s Sports and Convention Center .
(7)City owned properties that are licensed by the State of Wisconsin as a coliseum or
Airport/Public Facility.
(c)Only the lessee of such property(ies) may apply for the appropriate and applicable Class B
license(s), and then only if the particular, applicable lease, instrument, or agreement permits such
license, activity(ies), possession, sales, and consumption.
(d)Only fermented malt beverages and intoxicating liquors (including, but not limited to wines), as
permitted, purchased from the City or the City's lessee, licensee, or other permitted and/or authorized
person may be sold, possessed , and consumed on the City property and public facility. No fermented
malt beverages or intoxicating liquors of any kind may be brought into, transported, possessed,
consumed, or sold by any person other than the City , as applicable, or the City's lessee, licensee, or
other permitted and/or authorized person.
(e)All fermented malt beverages and intoxicating liquors shall be sold, possessed, and consumed
only in non-glass disposable containers.
(f)Only those persons of lawful drinking age may possess or consume intoxicating liquors and
fermented malt beverages under this and related sections, and by underage persons but only if such
underage person's parent or guardian accompanies the underage person and permits the possession
or consumption of the intoxicating liquors and fermented malt beverages. No underage person shall
possess or consume any permitted alcohol with the parent or guardian present at the time of such
underage person's consumption or without the express permission of such parent or guardian.
(g)The City Council of the City of Janesville hereby expressly and forever reserve unto themselves
all rights, privileges, and prerogatives to amend, condition, modify, revoke, or otherwise limit, at any
time, any alcohol beverage license or permit granted or issued by the City to the lessee, licensee, or
other permitted and/or authorized person but only after public hearing and public action thereon in
open session, the public peace, health, safety, welfare, and good so requiring.”
SECTION III. Section 6-27 of the Code of General Ordinances of the City of Janesville is hereby
repealed. All subsequent ordinances shall retain their current numbering.
