2025-2316REVISED RESOLUTION NO. 2025-2316 A resolution vacating Prairie Avenue north of Mayapple Drive. WHEREAS, perpetual easements for street purposes defining a portion of Prairie Avenue located north of Mayapple Drive are hereby determined to be no longer needed for public use, and therefore, the public interest requires the vacation of such street portion; and WHEREAS, it has been determined that the traffic flow will not be impeded by the vacation of such street portion; and WHEREAS, the proposed street vacation has been referred to the Plan Commission for its consideration and report as required by 62.23(5), Wisconsin State Statutes; and WHEREAS, a public hearing was held on vacation of such street portion and notice required by Wisconsin Statutes 66.1003 has been timely published and served; and WHEREAS, the Common Council finds the vacation of perpetual street easements in the best interest of the community and its residents and businesses; NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the following described perpetual easements for street purposes are hereby vacated and discontinued pursuant to 66.1003 and 62.22(lm), Wisconsin Statutes: Said easements being located within part of the NW 1/4 of the NE 1/4 of Section 25, T.3N., R.12E. of the 4th P.M., City of Janesville, Rock County, Wisconsin described as follows: Beginning at the NW corner of lot 10, Prairie Avenue Subdivision; thence westerly along the westerly extension of the north line of said lot, 70 feet to the west line of a 58 foot perpetual easement for street purposes as recorded per Document No. 649475; thence northerly along said west line, 491 feet more or less to the north line of the NW 1/4 of the NE 1/4 of said section; thence easterly along said north line, 70 feet more or less to the east line of a 12 foot perpetual easement for street purposes as recorded per Document No. 649474; thence southerly along said east line, 487 feet more or less to the place of beginning. BE IT FURTHER RESOLVED that the City of Janesville hereby retains an easement for municipal utility and access purposes over the southerly 20 feet of the area herein described.
