An ordinance repealing the reporting and certain related requirements set forth in Janesville’s Junk Dealer,
Secondhand Dealer, Secondhand Jewelry Dealer, and Pawnbroker Ordinance, JGO Chapter 12, Article X, with penalties and other relief for violations thereof as set forth therein.
THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS:
SECTION I. Janesville General Ordinance Subsection 12-273(b) is hereby amended to read as follows:
“(b) Every transaction is governed by the record keeping requirements set forth in state law and those set forth in this Article, each as from time to time amended or renumbered. Each item shall have a point-of-sale generated identification number and all other information required by this Article and by state law, cumulatively. Each junk dealer, secondhand dealer, secondhand jewelry dealer, and
pawnbroker must create and maintain a record of each purchase that describes each item, and must mark each item in a manner that relates it to the transaction record.
SECTION II. Janesville General Ordinance Subsections 12-274(a), (b), (c), (d), and (e) are hereby repealed in their entirety.
SECTION III. Janesville General Ordinance Subsection 12-274(f) is hereby renumbered 12-274.
SECTION IV. Janesville General Ordinance Subsection 12-275(a) is hereby amended to read as follows:
“(a) At the time of any transaction other than renewals, extensions, redemptions, or confiscations, every licensee must immediately record, in English, the following information in a manner required by law and approved by the Police Department, except for all consignment transactions, which must be
recorded as required by Wis. Stats. § 134.71(8)(c), as from time to time amended or renumbered:
(1)A complete and accurate description of each item, including, but not limited to, anytrademark, identification number, serial number, model number, brand name, and other
identifying mark for such an item.
(2)Date, time, and place the item of property was received by the licensee, and theunique alpha and/or numeric transaction identifier that distinguishes it from all other
transactions in the licensee's records.
(3)Full name, current residence address, current residence telephone number, date ofbirth and accurate description of the person from whom the item of the property was received,including sex, height, weight, race, color of eyes, and color of hair.
(4)The identification number and state of issue from any of the following forms ofidentification of the seller:
a.Current Wisconsin driver's license.
b.Current Wisconsin identification card.
c.Current valid photo identification card issued by another state or governmententity.
(5)The signature of the person identified in the transaction.
(b)The licensee must also take a color, digitized photograph of every item pawned or sold thatdoes not have a unique serial or identification number permanently engraved or affixed, excludingonly electronic media. One group photo shall suffice for mass items such as several coins acquired in
one transaction. If a photograph is taken, it must be at least two inches in length by two inches in
width and must be maintained in such a manner that the photograph can be readily matched and correlated with all other records of the transaction to which they relate. Such photographs must be
immediately available to the Chief of Police, or the Chief's designee, upon request. Items photographed must be accurately depicted and submitted as digital images, in a format specified by the issuing authority, electronically cross referenced to the reportable transaction they are associated
with. Consignment transactions shall be exempt from this requirement.
