An ordinance adopting the International Fire Code ("IFC") and the National Fire Protection
Association codes and standards ("NFPA") as part of the Janesville Fire Code (Janesville
General Ordinance Chapter 16), with penalties and other relief for violations thereof as set forth in Janesville General Ordinance Section 16-31.
THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS:
SECTION I. Section 16-19 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows:
"Sec. 16-19. -Adoption of IFC, codes, regulations; general provisions.
(a)The most recent, published edition of the International Fire Code, (hereinafter "IFC"), asfrom time to time amended or renumbered, is hereby adopted as the local use andmaintenance fire prevention code and is reiterated and incorporated herein as if fully setforth verbatim, with the following exception: Section 105 (Permits) of Chapter 1,"Administration," of the IFC is not included as part of the adoption of the IFC.
(b)The National Fire Protection Association (hereinafter "NFPA") codes and standards, asfrom time to time amended or renumbered, currently adopted by the State of Wisconsin,
are hereby adopted by reference, are reiterated and incorporated herein as if fully set forthverbatim, and are made a part of the City Fire Prevention Code with the same force andeffect as though set forth herein in full; unless otherwise found to be in conflict withsuperseding IFC, state, federal, or local law.
(c)When used in this Article, the term "Fire Code" shall include the IFC, the NFPA, all other
statutes, laws, codes, regulations, provisions, and standards incorporated above byreference, and City ordinances.
(d)Any act required to be performed, and any act prohibited by the Janesville Fire Code isrequired or prohibited by this article.
(e)This section adopts other Wisconsin statutes, administrative codes, fire codes, fire
regulations, fire provisions, applicable building and construction codes, referenced codes,and standards, as may supersede, supplant, or modify the IFC or the NFPA.
(f)Any violation of the IFC or the NFPA shall constitute a violation of this Article, a/k/theJanesville Fire Code.
(g)Failure to comply with any requirement set forth in this ordinance shall constitute a violationof this Janesville ordinance, related City of Janesville ordinances, and applicable provisionsof the International Fire Code and the NFPA.
(h)The City of Janesville retains and reserves unto itself the right to enforce such violation(s),
failures, and defaults in law and equity directly against such property and structure owners,possessors, tenants, assignees, conveyees, and other principals, for forfeiture and injunctiverelief.
(i)Each day's failure, default, non-compliance, incident, or continuance shall constitute aseparate violation.
U)Notwithstanding any contractual or other agreement or relationship between third parties andothers, each property and structure owner, possessor, tenant, assignee, conveyee, and other
principal is obligated to and must:
1)Fully and timely comply with every requirement set forth in this ordinance and in theInternational Fire Code, each as from time to time amended or renumbered; and
2)Directly contract, retain, and solely pay for such testing and other activities and processes
as required by this ordinance and/or the International Fire Code, each as from time totime amended or renumbered; and
3)Fully and timely pay all costs, fees, and expenses imposed and/or required to be charged,
paid, and/or collected for fire system testing, verification, related purposes, and otheractivities and processes in the manner and to the entity(ies), including, but not limited to,third-party reporting entities, designated, from time to time and at any time, by the
Janesville Fire Chief or his designee(s).
4)"Fire Watch" activities performed by the Janesville Fire Department personnel or others
on its behalf will be billed to, and must be timely paid by, the owner of the property upon
which the Fire Watch service and activities were conducted. The amount of that specialcharge shall be the fully burdened and weighted hourly rate of pay of the personnel
performing such services and activities, plus all related City of Janesville costs, fees, and
expenses."
SECTION II. This ordinance shall take effect on the 15th day of January 2025, and the public
health, welfare, and safety so required.
