Johnson Bros -$408,113.75  2011 -5 to Frank Silha & Sons -$467,635.5  2011 – 6 to Rawson Contractors -$1,121,783  2011 – 7 to Rock Road -$233,375.49 Map CITY OF JANESVILLE City Council Meeting March 14, 2011 Action on a Proposed Resolution Authorizing the City Manager to Execute a Lease with the American Legion Baseball of Janesville, WI for the Operation of a portion of Riverside Park (File Resolution #2011-779) City Manager’s Office March 14, 2011 Background  American Legion baseball has taken place at Riverside Park since the 1960s  No City funding available to maintain Veteran’s Field  Legion desires to lease the facility so they may continue to play games at the Field Contract Terms  Term is for 1 year, with option to renew annually for 5 years  Legion responsible for tasks associated with playing games at the field, while City responsible for grass mowing  Legion continues to offer concessions  Legion could advertise on the fencing Recommendation  Staff recommends the City Council adopt File Resolution #2011-779 to authorize the City Manager to execute an operating lease with the American Legion for a portion of Riverside Park. For questions or more information, please contact: City Manager’s Office (608) 755-3104 CITY OF JANESVILLE City Council Meeting March 14, 2011 Sidewalk Snow Removal Regulations and Procedures Department of Public Works March 14, 2011 Authority to Clear Snow From Sidewalks  State Statute 66.0907 (5) requires a city clear snow from sidewalks where an abutting property owner or tenant has failed to do so  State Statute also allows a city to pass along associated costs to the property owner  There are no Statutory time frames indicating how quickly snow must be cleared Authority to Clear Snow From Sidewalks  City Ordinance 12.08.080 requires snow be cleared from sidewalks within 12 hours after a snow event Current Procedures  Reactive – relies primarily on complaints  Inspections directed at specific complaint location and surrounding sidewalks  Where there is non-compliance, personal contact is attempted and a door-hanger is handed to the occupant or left on the door Current Procedures  Property owner/tenant is given 24 hours from time of notification to clear sidewalks  If non-compliance is observed upon reinspection, a City crew or its contractor will clear the sidewalk  Procedures remain the same for repeat instances of non-compliance Procedures in Peer Cities (16)  12 cities respond on a complaint-basis only  4 cities do some form of proactive inspection  12 cities utilize door-hangers for notification and informational purposes  3 cities mail non-compliance notices to property owners Procedures in Peer Cities (16)  12 cities use picture documentation when city crew or its contractor clear the sidewalk  5 cities implement inspection fees  3 cities implement administrative fees  4 cities issue citations Options  Pro-active inspections  Would require significant staff time if implemented city-wide  Could result in equity issues if the scope and frequency of inspections is not consistent citywide  Re-directs existing staff from other activities Options  Issue citations  Authority already exists in Ordinance  Provides additional financial incentive to comply with Ordinance  Would likely require extending citation authority to additional staff members  Particularly if inspect proactively  Property owners must be personally served the citation Options (Citations cont’d)  Each instance of non-compliance would need to be considered a violation, not just the first  Due process might be impacted because a property owner might not have had a chance to contest prior alleged instances of noncompliance  Notice of all prior instances of non-compliance would need to be provided a property owner at the time of each instance of non-compliance with an opportunity for the property owner to contest before an impartial person or group. Options  Implement re-inspection fee  Provides additional financial incentive to comply with Ordinance  To be assessed each instance of noncompliance after the first and where a City crew or its contractor clear a sidewalk  Neighborhood Services and Building Services each administer $50.00 re-inspection fees  If left unpaid, could be attached as a lien against the property Recommendation  Staff recommends maintaining the current procedures  Have improved compliance times from approximately 10 days under the former procedures to approximately 3 days (from receipt of complaint) Recommendation  Repeat violation statistics  318 total complaints during 2010/2011  57 (18%) required clearing by a City crew or its contractor multiple times CITY OF JANESVILLE City Council Meeting March 14, 2011
