Member Steeber was concerned that it be built to the needed capacity. Member Vesperman replied the modeling supports a four lane facility. Brad Cantrell, Community Development Director, stated Mark Gunn, Rock Twp Chairman does not object to the bypass and that adding the bypass to the 11/14 study does not necessarily mean it will be constructed. Member Steeber moved to recommend the 11/14 west bypass be added to the 11/14 study EIS. Member Perrotto seconded. Motioned carried 9-0-0 IV. The chairperson elected at that time is Member George Brunner and the vice chairperson is Member Russ Steeber. These terms are to expire at the end of October 2010. It would therefore be appropriate for the Policy Board to have nominations for these positions and to conduct the elections at this time. The term for Chair and Vice-Chair will expire on October 31, 2012. cc: Duane Cherek Janesville Area Metropolitan Planning Organization October 15, 2010 MEMO TO: Janesville Area MPO Policy Board FROM: Terry Nolan, MPO Coordinator SUBJECT: amendment to 2010-2015 Transportation Improvement Program Programming changes since the adoption of the 2010-2015 Transportation Improvement Program (TIP) have prompted the need for an amendment. The Wisconsin Department of Transportation (WisDOT) requests an amendment to add two state project s. The first project is 1001-07-01/71, a safety initiative for guardrail end treatments along I-39/90. Design is funded with a combination of federal Interstate Maintenance funds and state funds. Construction is currently listed with safety funding, however this has not yet been approved. It is possible that the construction may be funded with Interstate Maintenance funds if the safety funding is not approved. The second project is 5351-00-07, in which state funds will be used to begin design on improvements to the median at the intersection of USH 51 and STH 11. Construction for this project is not yet programmed. Following adoption of Resolution 2010-04 approving the TIP amendment, staff will forward the document to the appropriate state and federal transportation agencies. The MPO budget for 2011 consists of $101,250 in planning funds, with an additional $16,000 in discretionary planning funds. Thus, the total MPO planning budget for 2011 is 117,250 with the City of Janesville providing a 10.8% percent share, equal to $10,983. If the MPO is awarded discretionary funds, the City of Janesville will provide 20% as match. The funds are consistent with the previous year, when a state budget reduction resulted in an increased local share. The discretionary request is in keeping with previous years. In addition to the annual base allocation (101,250) granted for routine roadway and transit-related planning activities, $16,000 of Federal Discretionary funds (80% federal /20% local share) will be used for signal retiming/congestion mitigation along two corridors that each have a system of four signalized intersections: Centerway from Jackson St. to Parker Ave. and Center Ave. from Racine St. to State St. On October 5th, the Technical Advisory Committee forwarded the 2011 Unified Work Program to the MPO Policy Board with a favorable recommendation. PROGRAM ACTIVITY STATEMENT: The MPO covers the City of Janesville, the City of Milton and the towns of Harmony, Rock, Janesville, LaPrairie and Milton. The MPO is governed by a Policy Board consisting of the seven Janesville Council members, the City of Janesville City Manager, the City of Milton Mayor, a member from the Rock County Board of Supervisors, a representative from Wisconsin Department of Transportation Southwest Region Office, and the chairs from the Towns of Harmony, Janesville, La Prairie, Milton, and Rock. MPO planning funds are allocated to the City of Janesville in a cost-sharing formula that is 80% federal, 9.2% state and 10.8% local funds. The local funds are all in-kind support from the City of Janesville. The Janesville Area MPO also uses the services of Janesville city staff, consultants and interns where appropriate. Equality in Transportation Planning The Janesville Area Metropolitan Planning Organization (JAMPO) is committed to the equal distribution of transportation programs and services. A Non-Discrimination Agreement between the MPO and the Wisconsin Department of Transportation was signed in 2009. The agreement assures that no person shall on the grounds of race, color, national origin, and sex, be excluded from participation in, be denied the benefits of, or otherwise subjected to discrimination under any program or activity conducted by the MPO. The MPO Coordinator is the Title VI Coordinator responsible for initiating and monitoring Title VI activities and preparing required reports. The Non-Discrimination Agreement may be viewed on the City of Janesville website: www.ci.janesville.wi.us Janesville Metropolitan Planning Area Approved 2003 METROPOLITAN PLANNING FACTORS --The Federal Transportation Bill, the Safe, Accountable, Flexible, and Efficient Transportation Equity Act of 2005, A Legacy for Users (SAFETEA-LU) created the planning factors that were to be considered by Metropolitan Planning Organizations when developing transportation plans and programs. This year’s UPWP is being developed considering the metropolitan planning factors from SAFETEA-LU. The eight metropolitan planning factors from SAFETEA-LU include: 1. Support the economic vitality of the metropolitan area, especially by enabling global competitiveness, productivity, and efficiency. 2. Increase the security of the transportation system for motorized and non-motorized users. 3. Increase the safety aspects of the transportation system for its users. 4. Increase the accessibility and mobility options available to people and for freight. 5. Protect and enhance the environment, promote energy conservation, and improve quality of life. 6. Enhance the integration and connectivity connectivity of the transportation system, across and between modes, for people and freight. 7. Promote efficient system management and operations. 8. Emphasize the preservation of the existing transportation system. The following matrix illustrates the 2011 MPO work elements and the metropolitan planning factors to be addressed in each project. Major Accomplishments of the 2010 Work Program: Prepared the 2011– 2016 Transportation Improvement Program (TIP). Processed one amendment and one administrative modification to 2010-2015 TIP Prepared the 2011 Work Program and budget. Attended WisDOT directors meetings. Participated in Highway 11/14, and the Highway 26 corridor studies. Coordinated regional transit planning effort between Janesville, Milton, and Whitewater. Prepared grant applications for TE pedestrian/bicycle trail facilities, STP-Urban road projects, and transit operations. Assisted with regional land use planning efforts. Worked on update/reaffirmation of 2005-2035 Long Range Transportation Plan Conducted Janesville downtown parking studies during construction of downtown parking garage and after construction. Conducted Janesville trail user count and user opinion survey. (intern project) Assisted member jurisdictions with SRTS, and other federal and state grant applications. Verified addresses for the 2010 Census, and participated in Rock County Complete Count. Completed Milwaukee Street/Court Street study. Prepared Safe Routes to School Plan. Began implementation of recommendations. Title VI and Environmental Justice Accomplishments: Mapped locations of minority and low-income populations in relation to the TIP projects. Held public information meetings in relation to the TIP, and Work Program. Submitted documents to FTA for triennial review demonstrating compliance with certifications and assurances. The Key Components of the 2011 Work Program: Implementation of 2005-2035 LRTP policies and projects. Continue to assist in downtown redevelopment efforts. Continue to assist with efforts to improve parking and circulation in the urban, and overall planning area. Work with WisDOT to identify potential park-n-ride locations within the region. Continue bicycle/pedestrian facility planning. Complete update of LRTP. Participate in I-39/90 Corridor Study, HWY 14 from 92 to I-39 study, and HWY 14/11 Corridor Study to I-43. Assist with development of a new transit garage. Continue to monitor regular transit route service, including an evaluation of potential route changes to serve new hospital. Provide technical assistance to members of the MPO. Assist in establishment of a commuter route between Janesville, Milton and Whitewater, and the study of local feeder services. Continue to gather and update information needed for GIS system, including tracking performance indicators. The TIP lists all roadway, transit, elderly/disabled, and bicycle/pedestrian projects scheduled to use federal funds over the next six-years. Table 1A lists the roadway projects, Table 1B lists transit projects, Table 1C lists projects for elderly and disabled persons , and Table 1D lists enhancements planned for the bicycle and pedestrian network. The tables list the sponsoring jurisdiction for each project as well as the scheduled date of construction. SAFETEA-LU requires that project costs be shown in the “year of spending”. The MPO asked that all projects be submitted in 2010 dollars. Staff then applied a yearly inflation factor of 2.8%, as WisDOT directed, to bring the values into year of spending. MPO staff has taken the steps necessary to list the projects in the 2011-2016 TIP in a manner that is compliant with SAFETEA-LU requirements. The TIP shows full funding for a project in the year it is scheduled. For projects carrying over multiple years, projects are noted as continued (cont’d) in the table with a note in the comments section indicating the calendar year in which funding for the phase of work was obligated. Each year the Janesville Area Metropolitan Planning Organization (MPO) updates the TIP for the Janesville Urbanized Area. Federal regulations require that certain federally funded transportation improvement projects in urbanized areas must be included in a TIP. The TIP shall be endorsed by the MPO Policy Board and approved by the Wisconsin Department of Transportation on behalf of the Governor prior to receiving the Federal Highway Administration's or Federal Transit Administration's acceptance. The MPO TIP has been prepared in accordance with the provisions contained in the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) of 2005. The MPO conducts transportation planning under regulations applying to urbanized areas with populations under 200,000 and with attainment status for air quality. The U.S. Environmental Protection Agency may may designate Rock County as a non-attainment area in the future. In order to be prepared should this happen, the MPO will continue to monitor congestion problems and air quality compliance despite the positive air quality status currently held. TIP Requirements Per SAFETEA-LU requirements, the development and format of the TIP must adhere to the following requirements: a) Include a four-year priority list of projects significant to the region; b) Include a financial plan; c) Include highway, transit, and bicycle/pedestrian projects to be funded with federal monies; d) Public notice and public comment opportunities for interested parties must be provided prior to TIP approval; e) Be approved by the Governor or the Governor’s designee at WisDOT; f) Map all projects in relation to low-income/minority populations for Environmental Justice analysis; g) Projects costs must be inflated to the year of spending using a 2.8% yearly inflation rate. After the TIP is reviewed and approved by the Technical Committee, the document is forwarded to the MPO Policy Board for final local review. Following Policy Board approval, the TIP is submitted to the appropriate state and federal agencies for approval. With approval, WisDOT will include the Janesville Area TIP in the Statewide Transportation Improvement Program (STIP). 2011-2016 TIP Review Schedule MPO Technical Advisory Committee: October 5, 2010 MPO Policy Board: October 25, 2010 The Policy Board resolution endorsing the document is in Appendix C. The MPO Policy Board's endorsement of this document constitutes the MPO's approval of the projects included for funding. Furthermore, it is understood by the Policy Board that only those projects that are funded with state and federal dollars contained in WisDOT's local program for the MPO planning area are officially endorsed. TIP Amendments A TIP amendment is required in the following situations; as defined in the MPO’s Public Participation Plan and adopted by the Policy Board. The following sections briefly describe the type of short and long range plans used by the MPO. Short Range Plans Transit Development Plan On an approximate five-year basis, the City of Janesville and the Janesville Area MPO prepare a Transit Development Plan (TDP) update. The most recent update of the TDP was completed in 2007. A TDP typically evaluates service efficiency, route alignments, and identifies a five-year capital improvement program for the transit system. As part of the ongoing program to assess the public’s attitudes toward transit service and operations, MPO and JTS staff may conduct on-board ridership surveys, marketing surveys, on-off counts, and telephone surveys. Survey results assist the City of Janesville to determine existing and potential demand for transit services. The transportation act, SAFETEA-LU, encourages local governments to consider alternative modes of transportation such as transit, bicycle, and pedestrian facilities for project study and implementation. The 2011-2016 TIP identifies projects for transit operations and capital improvement projects. By endorsing the 2011-2016 TIP, the MPO Policy Board finds that all projects included in this document are consistent with the goals, objectives, and policies of the most recently adopted 2007 Transit Development Plan. Long Range Plans MPO Transportation Plan The Long Range Transportation Plan, adopted in 2006, identifies the Janesville Area MPO planning area’s existing transportation conditions and those areas where improvements should be made to adequately provide a cost effective and efficient transportation system. Projects in the TIP have been listed or identified in the 2035 Janesville Area MPO Long-Range Transportation Plan. By endorsing the 2011-2016 TIP, the MPO Policy Board finds that all projects included in this document are are consistent with the goals, objectives, and policies of the Long Range Transportation Plan. Critical Area Plans The City of Janesville projects included in the 2011-2016 TIP are consistent with the recommendations of the applicable critical area plans. Financial Capacity Planning The United States Department of Transportation has identified financial capacity planning as a national emphasis area for inclusion in the TIP. The 2005-2035 Janesville Area Long Range Transportation Plan includes project cost analysis, funding projections, and the 2007 Transit Development Plan evaluated the financial and service impacts of implementing recommended alternatives. In compliance with FTA Circular 7008.1, this TIP has been prepared with due consideration given to the member jurisdiction’s/MPO's ability to pay for the projects included herein. In addition, each year we provide the necessary self-certification required with the annual grant applications. 5 Clean Air Planning /Attainment Status The Janesville planning area currently meets required clean air standards and is an attainment area. The MPO and JTS will work together to ensure that conformity with the standards specified in the Clean Air Act continues in the future. In accordance with the Federal Clean Air Act, all federally assisted highway and transit projects in non-attainment areas must be derived from transportation plans and transportation improvement programs that are in conformity with the criteria stated in the Act. SAFETEA-LU and the TIP The MPO and WisDOT agree that the first year of the TIP constitutes an 'agreed to' list of projects for project selection purposes and no further project selection action is required for WisDOT or the transit operator to proceed with federal fund commitment. If WisDOT or the transit operator wishes to proceed with a project(s) not in the first year of the TIP, the MPO agrees that projects from the second, third or fourth year of the TIP can be advanced to proceed with federal fund commitment without the MPO being further involved in their project selection. Even though a new TIP has been developed and approved by the MPO, WisDOT can continue to seek federal fund commitment for projects in the previous TIP until a new STIP has been jointly approved by FHWA and FTA. It is the intent of WisDOT and the MPO to advance only projects, including transit operating assistance, that are included in an approved TIP and STIP. Concerning the federal funding sources the MPO has identified for individual projects in its TIP, it is agreed that WisDOT can unilaterally interchange the various FHWA funding program sources without necessitating a STIP or TIP amendment, except that WisDOT must seek MPO staff approval to use allocated STP-Urban funds for projects not identified for that source of funding in the TIP. 6 CHAPTER 2 -DESCRIPTION OF ROADWAY PROJECTS, 2011-2016 This chapter presents the highway project element of the TIP. Roadway projects are shown on Figure 1 and listed in Table 1A. Funding Availability Funding is available from federal, state and local sources to finance roadway projects in the Janesville Planning Area. All transportation projects that use federal or state funds must be included in the TIP. Several funding programs are flexible and may be used for various modes of transportation: a) Surface Transportation Program (STP): May be used toward roadways, bicycle, pedestrian, transit and some forms of multi-modal facilities. b) FTA (Section 5307) transit capital funds c) Highway bridge replacement and rehabilitation projects d) National Highway System (NHS) projects e) Interstate Maintenance (IM) projects. PROJECT LISTING There are 50 roadway projects identified in Table 1A. The code numbers shown in the “Comments” column of each table are for WisDOT referencing purposes only. Prioritization of projects is based on the funding availability, and year of project initiation, as indicated by the applicable jurisdiction. The funding codes used in Table 1A are identified below. In most cases, a project phase is completely funded at the start of the project. Therefore, the TIP shows full funding for a project phase in the first year corresponding with the schedule date. The continuation of the project beyond the year of funding is shown by noting “cont’d” in the table, along with a note in the comments section indicating the calendar year in which funding for the phase of work was obligated. Prioritization of STP-Urban Funds In the spring of odd years, the MPO solicits applications for projects seeking STP-Urban funds. Due to the American Recovery and Reinvestment Act of 2009, the STP solicitation was delayed until 2010. In 2010, the City of Janesville responded with two eligible projects and the City of Milton responded with one eligible project. However, Milton withdrew the project at the Technical Advisory Committee meeting. Evaluation of the potential projects involved assessment of the roadway condition, age of existing improvements, ADT, roadway classification, estimated project cost, connectivity and total funding availability. Main Street from Centerway to St. Lawrence in the City of Janesville was determined to be the project of 7 the greatest significance and priority based on the requests received by the MPO for STP-Urban funded projects. In November of 2007 the MPO developed the TIP Prioritization Process to formally prioritize the selection of projects eligible for STP-Urban funds, and any other applicable federal funds requiring ranking by the MPO. STP solicitation in 2010 revealed the need to devise a method for sharing STP funds equitably. The following table lists transit operating and capital projects to be funded over the next six years. The project description table is preceded by a brief discussion of the funding available to finance transit projects. FUNDING AVAILABILITY Funding for transit projects in the Janesville urbanized area is available from federal, state and local sources. The Janesville urbanized area receives operating and capital assistance under Section 5307 of the Federal Transit Act. Over the 6-year TIP period, it is anticipated that $6,000,000 in operating assistance funds will be available. Section 5307 operating and capital funds are received and distributed by WisDOT to the 14 eligible urban areas with populations between 50,000 and 200,000. The total federal share of transit operating projects in the transit element of the TIP does not exceed the apportioned Section 5307 funds available to the urbanized area. Capital projects are proposed to be funded primarily by Section 5309 funds, with some backfill from Section 5307. WisDOT provides transit operating assistance to urbanized areas through Section 85.20 of the Wisconsin Statutes. JTS can recover a portion of the total transit system operating costs through this program. This program does not provide a statutory percentage of expense coverage. However, for planning purposes, it is assumed that approximately 25% of costs will be covered under this program. The remaining transit operating and capital costs are covered by user fees (operating revenue) and local assistance (City of Janesville General Fund, which may be supported by bonding for major capital projects). Major Capital projects are funded by Section 5309 federal discretionary capital funds, administered by WisDOT. The normal annual funding amount is dependent upon the political process, making the annual amount variable. Should funding run out in a given year, projects are reprogrammed to later years. WisDOT’s policy states that bus replacements have first priority for capital funding should a funding shortfall occur. Section 5309 funds have a 20% local share, which the City of Janesville pays for through general fund revenues or bonding. TRANSIT SERVICE The Janesville Transit System operating assistance projects included in this TIP represent a continuation of the current level of service. Currently JTS operates six daytime routes. These routes operate on Monday – Friday, from 6:15 AM – 6:15 PM and 8:45 AM to 6:15 PM on Saturdays. JTS also operates three night service routes that run Monday – Friday from 6:15 PM – 10:15 PM. In addition, JTS includes service to Beloit. The Beloit-Janesville Express operates 6:15 AM – 6:15 PM Monday – Friday. The City of Milton is developing a shared-ride taxi service to begin operating sometime in 2011. Service area, hours of operation and revenue have yet to be determined. Private transportation providers are contacted when transit service is restructured or changed. Appendix B contains a summary of the private enterprise participation process utilized to inform and involve private transportation providers in the transportation planning and programming process. ELDERLY AND DISABLED SERVICES (Janesville Transit System) The Janesville Transit System (JTS) route structure is designed to serve all major elderly and handicapped generators. The JTS fleet consists of 20 buses, 6 of which operate during peak and off-peak hours over the regular routes. The remaining buses are used to provide peak hour tripper, Beloit-BTC-Janesville and evening service. All of the buses are equipped with wheelchair lifts or ramps and wheelchair tie down positions. All buses have kneeling devices, which allows JTS to meet U.S. Department of Transportation "504" and ADA Regulations. Accessible bus service is provided on all headways. 18 A contract with an existing service provider, Rock County Specialized Transit (RCST), provides paratransit service that complements the Janesville Transit System. RCST is a county government agency that provides transportation within the JTS service area as well as the rest of Rock County. JTS provides regular fixed-route service outside the normal operating hours of RCST in the early morning, late afternoon and on Saturday. In order to meet the requirement for complementary paratransit service, RCST provides service during these same time periods. Paratransit service is available during the same hours as fixed-route service is available in the JTS service area. 19 PROJECT LISTING Transit operating assistance and capital projects are listed in Table 1B for 2010-2015. Project submittals are usually in the form of requests for handicap accessible buses or vans. Projects are listed in Table 1C. ELDERLY AND HANDICAPPED (E/H) SPECIAL EFFORT SERVICES Currently there are at least half a dozen public and private organizations that provide transportation to the elderly and handicapped in Janesville. The private for-profit organizations include: Van Galder Bus Company, Jim’s Cab, and Call-Me-A-Cab, Inc. The public and private non-profit organizations include: Rock County Health Care Center, Kandu Industries, Rock County Council on Aging (Specialized Transit Division), Rock County Social Services (Driver Escort Program), Lutheran Social Services, Community Action, and the Janesville Transit System. Of these organizations, only the Janesville Transit System, Community Action, and the Rock County Council on Aging anticipates using federal DOT or WisDOT funding in the 2011-2016 TIP. Table 1D includes projects from the Janesville Area Long Range Transportation Plan, and Statewide Multi-Modal Improvement Program (SMIP) applications. FUNDING AVAILABILITY A portion of Surface Transportation Program (STP) funds are designated to be used only for "transportation enhancement" activities. The Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) maintains a multimodal focus by continuing the Enhancements program. Project categories eligible for Enhancements funding are listed below: 1. Provision of facilities for pedestrians and bicycles 2. Acquisition of scenic easements and scenic or historic sites 3. Programmed expenditures in the TIP have been compared to the funding estimated to be available, federal, state and local. Included are federal highway and federal transit funding sources. The MPO was only given estimated available funding levels for the FHWA STP-Urban program. In the event of over programming of funds, technical advisory committees at the state and local levels will work to resolve the discrepancy. This may involve the use of alternative funding sources from federal or state funds, or reprogramming projects to alternate years when funding will be available. Operations and Maintenance Funds Any costs associated with providing street Maintenance and Operations (O&M) activities are funded entirely by the local operating budgets of the various jurisdictions within the Janesville MPO. These O&M funds are completely separate from the capital improvement funds provided for in the TIP and do not affect the cost estimates and corresponding fiscal constraints shown in this document. Implementation Status Table 3 lists major transportation projects from the previous TIP that are currently underway, completed, redefined, deferred or have been dropped. Funding Summary for 2011-2016 TIP ($1,000) 33 CHAPTER 7 -ENVIRONMENTAL JUSTICE IN THE TRANSPORTATION IMPROVEMENT PROGRAM This chapter is included to fulfill the 1994 Presidential Executive Order 12898, Federal Actions to Address Environmental Justice in Minority Populations and Low-Income Populations. This order accompanied by Title VI of the 1964 Civil Rights Act attempts to identify, avoid, and minimize disproportionately harmful or hazardous health and environmental effects on low-income and minority populations. More specifically, the US DOT and FHWA identify three fundamental environmental justice principles: To avoid, minimize, or mitigate disproportionately high and adverse human health and environmental effects, including social economic effects, on minority populations and low-income populations. To ensure the full and fair participation by all potentially affected communities in the transportation decision-making process. To prevent the denial of, reduction in, or significant delay in the receipt of benefits by minority and low-income populations. Figures 3 and 4 illustrate the census tracts with higher than average low income or minority populations. All of these areas are located within the City of Janesville, with the exception of one census tract with above average minority population located within the Town of Janesville. This is most likely due to the presence of the Rock County Jail within that census tract, and therefore is not representative of the residential population within the area. Roadway Projects and Low Income/Minority Populations Roadway projects affecting census tracts with higher than average minority and low income populations are shown in Figure 3. The following projects in Figure 3 are within or along the boundary of tracts both with higher than average minority and low income populations: Project #1, River Street reconstruction; project # 5, Jackson St. Bridge replacement, project # 12, S. Jackson St. at Milwaukee resurfacing; project # 13, W. Milwaukee St. (Center to bridge) resurfacing; project # 48, USH 51 and Union Pacific RR crossing. The following projects in Figure 3 impact tracts with a higher than average low income population: Project # 3, N. Main St. resurfacing; project # 6, S. Pearl St. reconstruction; project #8, STH 26 from Parker Dr. to 800’ N. of Randolph Rd. reconstruction; project #14, S. Arch St. resurfacing; project #17, N. Pearl St. resurfacing. The following projects in Figure 3 impact tracts with a higher than average minority population: Project #27, Westside bypass; project # 18, Rockport Rd. resurfacing, project # 20, S. Oakhill resurfacing; project #21, Kennedy Rd. resurfacing; projects #14 & 47, HWY 14 pavement replacement; project #29, CTH F resurface/reconstruct from USH 14 to Edgerton; project # 26, E. Milwaukee resurfacing, project #4, Austin Rd reconstruction. With the exception of the Westside bypass, these projects are reconstruction or resurfacing projects that are expected to improve the quality and safety of the existing road system. The following projects are studies scheduled in areas with higher than average minority populations: project #43, USH 11/14-corridor study and EIS. Transportation Enhancement Projects and Low Income/Minority Populations The existing and planned transportation enhancement projects are well dispersed throughout the urban area, as shown in Figure 4. The majority of the environmental justice target areas are located within a ½ mile of a bike/pedestrian trail. TIP Projects and Direct and Indirect Impacts on Low Income/Minority Populations Taken in whole, the projects in the Janesville Area 2011-2016 Transportation Improvement Program, together with the other public and 34 privately funded transportation improvements and services provided in the Janesville urbanized area, do not impose disproportionately high and adverse impacts on minority populations and/or low income population. Furthermore, the benefits of the transportation services and improvements proposed are reasonably distributed to serve the mobility and accessibility needs of all population groups within the Janesville Area MPO. These statements are based on the analysis of proposed projects, their locations, and impacts on both low income and minority populations as summarized in Chapter 7 of this document. Public Involvement of Low Income/Minority Populations Attempts to involve low income and minority populations in the creation of the TIP can be found in Chapter 8, PUBLIC PARTICIPATION, of this document. 35 36 37 CHAPTER 8 – PUBLIC PARTICIPATION IN THE TRANSPORTATION IMPROVEMENT PROGRAM The TIP is prepared as a cooperative effort by the MPOs, the Wisconsin Department of Transportation, transit operators and the local agencies that implement transportation projects. The document is primarily based the Janesville Area MPO Long-Range Transportation Plan. Public involvement procedures for the TIP are described in three stages identified below. Detailed procedures are outlined in the Janesville Area MPO’s Public Participation Plan (November 2006). WisDOT relies on the public involvement process conducted by the MPO in the development of the TIP, to satisfy the Federal Transit Administration program and planning requirements, as established for the Section 5307/5309 programs. TIP Development Process Stage 1 -Requests For Projects Requests for projects to be included in the TIP are solicited from all units of government in the Janesville Planning Area (City of Janesville, City of Milton, Towns of Harmony, Janesville, LaPraire, Rock, and Milton and Rock County) plus the State of Wisconsin. Public and private transportation providers, including those that provide transportation to the elderly and handicapped, are also eligible to submit capital acquisition projects. Inclusion of projects in the TIP is based on funding availability and compliance with short and long range plans for the metropolitan planning area. The submittals initiate the public involvement process and provide opportunity for input into the TIP. A legal notice is printed in the local newspaper announcing the development of the TIP to the general public. Individuals are afforded the opportunity to contact the MPO to learn more about the TIP and provide any comments on the process. The MPO will document all public comments prior to the development of the TIP. Stage 2 -Draft TIP Review The draft TIP is developed by the MPO staff after receiving project proposals to be included in the document. The TIP summarizes highway, public transportation and other modes of public transportation projects, including capital acquisition, that are scheduled over the next six years. The Draft TIP is sent to all members of the MPO Technical Advisory Committee plus all other transportation providers (both public and private) in the metropolitan area. The MPO Technical Advisory Committee meets to discuss the projects that have been included in the draft TIP. Additions or deletions to the list are suggested at this time. The general public is invited to attend this open meeting with a notice published in the local newspaper that serves the MPO planning area. Copies of the Draft TIP are available for public review at the local libraries, JTS, and the MPO office at City Hall (Planning Services Division). Oral and written comments on the Draft TIP are taken by the MPO and documented prior to the development of the Final TIP. Stage 3 -Final TIP Distribution The final TIP is submitted to FHWA, FTA, WisDOT, and other local levels of government in the MPO planning area after no further significant changes are made to the draft TIP. The MPO Policy Board determines final approval of the TIP. Any significant additions or deletions to the TIP require a further review and public comment period. The shifting of projects between years within the TIP does not dictate additional public review and comment. 38 Major amendments to the TIP are published in the local newspaper serving the MPO planning area. Copies of the Final TIP are available for public review at the local libraries and also at the MPO office at City Hall (Planning Services Department). The MPO will, if requested by a number of organizations and individuals, hold a separate public information meeting or public hearing to present an overview of the TIP. Individuals would have the opportunity to speak with MPO staff and make any comments concerning the document. Individuals may make oral comments, provide written comments or contact the MPO staff at the appropriate address. The site for a meeting or hearing would be of adequate size for the audience, accessible to persons with disabilities, located on or convenient to public transportation routes and provide adequate parking. A time would be chosen so that a maximum number of people could attend. Meetings will be scheduled so that persons who must rely on public or specialized transit can attend and still return home during the hours of operation of those systems, and also accommodate those persons who work both during the day and in the evening. A sign language interpreter for hearing impaired persons will be provided upon request or when the nature of the meeting is such that attendance by hearing impaired persons is anticipated. Staff will provide assistance in describing exhibits or providing information in alternative formats upon request by visually impaired persons or those with other disabilities. Public Notice Stage 1 -Public notice of TIP development was published in the Janesville Gazette on August 16 & August 23, 2010. The notice stated that upon completion of the draft TIP another public notice would be published stating where the document could be reviewed for general public comment. (Exhibit A) Stage 2 -Public notice of draft TIP review by the TAC was published in the Janesville Gazette on September 10, 2010. (Exhibit B). Public notice of the TIP review & approval by the Policy Board was published in the Janesville Gazette on October 11, 2010. (Exhibit C). Parker Drive Janesville, WI 53545 608-755-3150 43 APPENDIX B -PRIVATE ENTERPRISE PARTICIPATION PROCESS JANESVILLE AREA MPO DESCRIPTION OF PLANNING AND PROGRAMMING ACTIONS INCOMPLIANCE WITH FTA'S POLICY OF PRIVATE ENTERPRISE PARTICIPATION IN THE URBAN MASS TRANSPORTATION PROGRAM Overview The Janesville Area Metropolitan Planning Organization has developed a process for the inclusion of private providers of transportation services into all phases of transportation planning and programming in the Janesville area. This process was developed in response to the Federal Transit Administration's guidance on documentation of private enterprise participation in Urban Mass Transportation Programs, published in the Federal Register on 24 January 1986. This policy states that: The City of Janesville will encourage the provision of adequate privately owned and paratransit transportation services. Description of the Private Section Involvement Process Participation in Wisconsin Department of Transportation Privatization Study. The Janesville Area MPO will maintain an inventory of all private transportation providers in the Janesville Urbanized Area. The MPO staff will notify private operators of all Technical Committee and Policy Board meetings at which transit items are to be discussed. Private operators will also be notified of public hearings and plans which involve the establishment of new transit services or the expansion of existing transit services. Staff will ask private operators to participate in the evaluation of these services at MPO Technical and Policy Board meetings. The Janesville Area MPO staff will notify private operators of plans for new and/or restructured services as part of the annual Transportation Improvement Program Update. With the notification, private providers will be made aware of where they can obtain a copy of the TIP. If a private provider indicates an interest (in writing) in providing a new or restructured service, the MPO staff will work with the Janesville Transit System (JTS) to see that specifications for the service are provided to the private operator. The private operator will be asked to submit a proposal. The proposals will be evaluated based on criteria which is developed and made available to the private provider early in the process. The Janesville Area MPO staff provides technical assistance and public information to individuals and organizations that request it. This includes private transportation providers that may request information or assistance with projects related to transit planning and programming. New and Restructured Services The Rock County Council on Aging/Specialized Transit Program intends to apply to the Wisconsin Department of Transportation for a federal grant under Section 5310 of the Federal Transit Act. They have requested two handicap accessible vans to replace the existing vans in their fleet. Community Action is requesting JARC funds for their car-loan program, and New Freedom fund for their mobility management program. Description of Private Sector Proposals Community Action is requesting New Freedom funds for their mobility management program. Private Sector Capital Investment Strategies There are no new major private sector capital projects programmed in the 2011-2016 TIP. Complaint Disposition Process 44 This process refers specifically to the Federal Transit Administration's Private Sector Participation Policy as set forth on October 22, 1984 and January 24, 1986. The purpose of this complaint disposition process is to set forth the formal procedures that will be used to resolve disputes between a private transportation provider and public agency. The intent of this process is to develop a procedure that will be used to resolve disputes between a private transportation provider and a public agency. The intent of this process is to develop a procedure that will be followed where other established procedures are delineated in contracts and bid documents will be used to resolve disputes in these areas. Where these procedures are not applicable, the following process will be employed. 1. The complainant requests the appropriate public agency (JTS) to review the complaint. The public agency (JTS) responds within 30 days. The complainant, if not satisfied can request a meeting with agency representatives. The The administrator overseeing the agency (e.g. the Assistant City Manager in the case of JTS) issues a determination within 60 days. 2. If the complaint is not resolved, the private provider can file a formal complaint with the Janesville Area Metropolitan Planning Organization's Technical Advisory Committee. The composition of the committee is attached. The committee or its designee reviews the complaint and issues a determination within 60 days from receipt of the complaint. The criteria used to evaluate the complaint will be developed on a case-by-case basis.
