#3 Rezoning property within 4700 block of Milton Avenue (File Ord. #2009-429)
Community Development Department Memorandum March 17, 2009 TO: Janesville City Council FROM: Bradley Cantrell, Community Development Director SUBJECT: Public Hearing, Rezoning of property within the 4700 block of Milton Avenue from Agriculture to B2, Community Shopping District and Conservancy (File Ordinance No. 2009-429). Summary At the last City Council meeting on March 9, review and action on this item was postponed until the March 23, 2009 meeting. That delay was requested to provide City staff and the developer with additional time to complete various components of the Jack Willow development proposal, located near the intersection of STH 26 and McCormick Drive. The project involves the installation of a number of public improvements that include utility service extensions, storm water management facilities and construction of street and intersection improvements required to provide a connection to Highway 26. Rezoning of property in this location is one of several actions to be brought forward for Council review at this time related to the project. However, the developer recently informed staff that they are unable to secure the level of funding necessary to finance the proposed development at this time. As a result, staff believes it is appropriate to table the proposed rezoning of property until the developer is in a position to proceed with the project. Recommendation Because a public hearing has been scheduled for March 23, it would be appropriate for the Council President to open the public hearing, allow anyone wishing to speak to do so, and then close the public hearing. The Community Development Department requests that the City Council table action on a proposed ordinance rezoning property within the 4700 block of Milton Avenue from Agriculture to Conservancy and B2, General Commercial District (File Ordinance No. 2009-429).
