08-9 Proposed Annex & Zoning Ord 2007-362 & 363 Community Development Department Memorandum ~ Date: May 22, 2007 TO: Steven E. Sheiffer, City Manager FROM: Duane Cherek, Manager of Planning Services ~ SUBJECT: Introduction and schedule a public hearing on a proposed ordinance annexing property located at the northeast corner of Austin Road and Mineral Point Avenue (File Ordinance No. 2007-362); and Introduction, refer to Plan Commission and schedule a public hearing zoning property located at the northeast corner of Austin Road and Mineral Point Avenue to R1 upon annexation (File Ordinance No. 2007- 363). Michael and Milissa Rick, and Geraldine McCluskey, have submitted a valid petition to annex approximately 57 acres of land located at the northeast corner of Austin Road and Mineral Point Avenue. The subject property contains an existing residence and outbuilding, but is primarily undeveloped and in agricultural use. Following annexation, the petitioners intend to subdivide the property for single-family residential development. Ordinance No. 2007-362 has been prepared to annex the subject site to the City of Janesville. Coincident with the ordinance annexing the land, the Community Development Department has also prepared Ordinance No. 2007-363 which will zone the property to R1, Single and Two-Family Residence District, upon annexation. This designation will accommodate the proposed residential development plans for the subject property as proposed by the land owners. The Community Development Department recommends that following the first reading of Ordinance No. 2007-362 and Ordinance No. 2007-363, they be set for public hearing on June 25, 2007. While the annexation does not require Plan Commission review, the zoning of the property must be referred to the Plan Commission. We therefore recommend that Ordinance No. 2007-363 be referred to the Plan Commission for review and recommendation. cc: Brad Cantrel~ ORDINANCE NO. 2007-362 An ordinance annexing territory in Section 27 in T.3N., R.12E. ofthe 4th P.M., Town of Janesville, Rock County, Wisconsin. WHEREAS, a petition signed by the owner of the land within such territory proposed to be annexed has been filed with the City Clerk; and WHEREAS, there are two electors residing in the territory; and WHEREAS, the necessary notices have been duly prepared, provided and served as required by law to ail persons affected; and WHEREAS, this ordinance does not contain temporary zoning; and WHEREAS, the Department of Administration has not found the proposed annexation to be against the public interest; and WHEREAS, the Common Council has determined that this annexation is in the public interest. NOW THEREFORE THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. The territory described as foilows is hereby annexed to the City of Janesviile. SECTION III. All the territory annexed by this ordinance is hereby made part of Ward 27 of the City of Janesville. SECTION IV. There are two residents in the area proposed for annexation. SECTION V. The annexation area is within the Janesville School District. SECTION VI. This ordinance shall take effect immediately upon adoption by the Common Council, the public health, welfare, peace, tranquility, good order, public benefit, and police power so requiring.
